| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 91.116, Natural Resources Code, is | |
| 11 | 11 | amended by amending Subsection (b) and adding Subsection (e) to | |
| 12 | 12 | read as follows: | |
| 13 | 13 | (b) A person who files an application for a permit for a | |
| 14 | 14 | commercial surface disposal facility shall provide [publish] | |
| 15 | 15 | notice of the application in accordance with this section. | |
| 16 | 16 | (e) In addition to publishing notice of the permit | |
| 17 | 17 | application as required by Subsection (d), the applicant shall give | |
| 18 | 18 | notice of the permit application to a river authority or | |
| 19 | 19 | groundwater conservation district whose territory contains the | |
| 20 | 20 | tract of land on which a disposal pit will be located or on which the | |
| 21 | 21 | disposal will take place. | |
| 22 | 22 | SECTION 2. Section 91.116, Natural Resources Code, as | |
| 23 | 23 | amended by this Act, applies only to an application for an oil and | |
| 24 | 24 | gas waste disposal permit that is filed on or after the effective | |
| 25 | 25 | date of this Act. An application for a permit filed before the | |
| 26 | 26 | effective date of this Act is governed by the law in effect on the | |
| 27 | 27 | date of filing, and that law is continued in effect for that | |
| 28 | 28 | purpose. | |
| 29 | 29 | SECTION 3. This Act takes effect September 1, 2021. |
