9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Chapter 2, Code of Criminal Procedure, is | |
11 | 11 | amended by adding Article 2.1387 to read as follows: | |
12 | 12 | Art. 2.1387. INTERVENTION REQUIRED FOR EXCESSIVE FORCE; | |
13 | 13 | REPORT REQUIRED. (a) A peace officer has a duty to intervene to | |
14 | 14 | stop or prevent another peace officer from using excessive force | |
15 | 15 | against a person suspected of committing an offense if an ordinary, | |
16 | 16 | prudent peace officer would intervene under the same or similar | |
17 | 17 | circumstances. | |
18 | 18 | (b) A peace officer who witnesses the use of excessive force | |
19 | 19 | by another peace officer shall promptly make a detailed report of | |
20 | 20 | the incident and deliver the report to the supervisor of: | |
21 | 21 | (1) the peace officer making the report; and | |
22 | 22 | (2) the peace officer who used the excessive force. | |
23 | 23 | SECTION 2. This Act takes effect September 1, 2021. |
