66 AN ACT
77 relating to a duty for peace officers to intervene and make a report
88 when a peace officer uses excessive force.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 2, Code of Criminal Procedure, is
1111 amended by adding Article 2.1387 to read as follows:
1212 Art. 2.1387. INTERVENTION REQUIRED FOR EXCESSIVE FORCE;
1313 REPORT REQUIRED. (a) A peace officer has a duty to intervene to
1414 stop or prevent another peace officer from using excessive force
1515 against a person suspected of committing an offense if an ordinary,
1616 prudent peace officer would intervene under the same or similar
1717 circumstances.
1818 (b) A peace officer who witnesses the use of excessive force
1919 by another peace officer shall promptly make a detailed report of
2020 the incident and deliver the report to the supervisor of:
2121 (1) the peace officer making the report; and
2222 (2) the peace officer who used the excessive force.
2323 SECTION 2. This Act takes effect September 1, 2021.
