9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 21.0111, Property Code, is amended by | |
11 | 11 | adding Subsection (a-1) to read as follows: | |
12 | 12 | (a-1) An entity seeking to acquire real property through the | |
13 | 13 | use of eminent domain shall, not later than the third business day | |
14 | 14 | before the date of a special commissioner's hearing, disclose to | |
15 | 15 | the property owner any and all current and existing appraisal | |
16 | 16 | reports produced or acquired by the entity relating specifically to | |
17 | 17 | the owner's property and used in determining the entity's opinion of | |
18 | 18 | value, if an appraisal report is to be used at the hearing. | |
19 | 19 | SECTION 2. The change in law made by this Act applies only | |
20 | 20 | to a condemnation proceeding commenced on or after the effective | |
21 | 21 | date of this Act. | |
22 | 22 | SECTION 3. This Act takes effect September 1, 2021. |
