9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Subchapter Z, Chapter 39, Utilities Code, is |
---|
11 | 11 | | amended by adding Section 39.918 to read as follows: |
---|
12 | 12 | | Sec. 39.918. ENERGY EMERGENCY ALERTS IN ERCOT POWER REGION. |
---|
13 | 13 | | (a) The commission shall require an independent organization |
---|
14 | 14 | | certified under Section 39.151 for the ERCOT power region to adopt |
---|
15 | 15 | | protocols to declare: |
---|
16 | 16 | | (1) an energy emergency alert level 1 when operating |
---|
17 | 17 | | reserves are less than 4,600 megawatts and are not expected to |
---|
18 | 18 | | recover within 30 minutes; |
---|
19 | 19 | | (2) an energy emergency alert level 2 when operating |
---|
20 | 20 | | reserves are less than 3,500 megawatts and are not expected to |
---|
21 | 21 | | recover within 30 minutes; and |
---|
22 | 22 | | (3) an energy emergency alert level 3 when operating |
---|
23 | 23 | | reserves are less than 2,000 megawatts and are not expected to |
---|
24 | 24 | | recover within 30 minutes. |
---|
25 | 25 | | (b) As soon as possible after an energy emergency alert is |
---|
26 | 26 | | declared or an alert level changes, the Texas Division of Emergency |
---|
27 | 27 | | Management shall request that the Federal Emergency Management |
---|
28 | 28 | | Agency issue a wireless emergency alert notifying residents of this |
---|
29 | 29 | | state of the declaration or change using mobile devices. |
---|
30 | 30 | | SECTION 2. Subchapter H, Chapter 418, Government Code, is |
---|
31 | 31 | | amended by adding Section 418.196 to read as follows: |
---|
32 | 32 | | Sec. 418.196. PUBLICATION OF INFORMATION RELATING TO ENERGY |
---|
33 | 33 | | EMERGENCY ALERTS. (a) In this section, "state agency" means a |
---|
34 | 34 | | department, commission, board, office, council, authority, or |
---|
35 | 35 | | other agency in the executive branch of state government that is |
---|
36 | 36 | | created by the constitution or a statute of this state, including a |
---|
37 | 37 | | university system or institution of higher education as defined by |
---|
38 | 38 | | Section 61.003, Education Code. |
---|
39 | 39 | | (b) If an independent organization certified under Section |
---|
40 | 40 | | 39.151, Utilities Code, for the ERCOT power region declares an |
---|
41 | 41 | | energy emergency alert, each state agency shall publish a |
---|
42 | 42 | | notification regarding the alert on the home page of the agency's |
---|
43 | 43 | | Internet website as soon as practicable. |
---|
44 | 44 | | SECTION 3. This Act takes effect September 1, 2021. |
