95 A BILL TO BE ENTITLED
106 AN ACT
117 relating to public access to certain hospital investigation
128 information and materials.
139 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1410 SECTION 1. Section 241.051, Health and Safety Code, is
1511 amended by amending Subsections (d) and (e) and adding Subsections
1612 (f), (g), and (h) to read as follows:
1713 (d) Except as provided by Subsection (e), all [All]
1814 information and materials in the possession of or obtained or
1915 compiled by the commission [department] in connection with a
2016 complaint and investigation concerning a hospital are confidential
2117 and not subject to disclosure under Chapter 552 [Section 552.001 et
2218 seq.], Government Code, and not subject to disclosure, discovery,
2319 subpoena, or other means of legal compulsion for their release to
2420 anyone other than the commission [department] or its employees or
2521 agents involved in the enforcement action except that this
2622 information may be disclosed to:
2723 (1) persons involved with the commission [department]
2824 in the enforcement action against the hospital;
2925 (2) the hospital that is the subject of the
3026 enforcement action, or the hospital's authorized representative;
3127 (3) appropriate state or federal agencies that are
3228 authorized to inspect, survey, or investigate hospital services;
3329 (4) law enforcement agencies; and
3430 (5) persons engaged in bona fide research, if all
3531 individual-identifying and hospital-identifying information has
3632 been deleted.
3733 (e) The following information is subject to disclosure in
3834 accordance with Chapter 552 [Section 552.001 et seq.], Government
3935 Code, only to the extent that all personally identifiable
4036 information of a patient or health care provider is omitted from the
4137 information:
4238 (1) a notice of the hospital's alleged violation
4339 [against the hospital], which must [notice shall] include the
4440 provisions of law [which] the hospital is alleged to have violated,
4541 and a general statement of the nature of the alleged violation;
4642 (2) the number of investigations the commission has
4743 conducted of the hospital;
4844 (3) the pleadings in any [the] administrative
4945 proceeding to impose a penalty against the hospital for the alleged
5046 violation;
5147 (4) the outcome of each investigation the commission
5248 conducted of the hospital, including:
5349 (A) the issuance of a reprimand;
5450 (B) the denial or revocation of a license;
5551 (C) the adoption of a corrective action plan; or
5652 (D) the imposition of an administrative penalty
5753 and the penalty amount; and
5854 (5) [(3)] a final decision, investigative report, or
5955 order issued by the commission to address the alleged violation
6056 [department].
6157 (f) Not later than the 90th day after the date the
6258 commission issues a final decision, investigative report, or order
6359 to address a hospital's alleged violation, the commission shall
6460 post on the commission's Internet website:
6561 (1) the notice of alleged violation described by
6662 Subsection (e)(1);
6763 (2) the name of the hospital;
6864 (3) the geographic location of the hospital;
6965 (4) the date the commission issued the final decision,
7066 investigative report, or order; and
7167 (5) the outcome of the commission's investigation of
7268 the hospital that includes the information described by Subsection
7369 (e)(4).
7470 (g) The commission may not remove information posted on the
7571 commission's Internet website under Subsection (f) before the
7672 second anniversary of the date the information is posted on the
7773 Internet website.
7874 (h) Nothing in this section precludes a hospital from
7975 releasing medical records in the hospital's possession on the
8076 request of the patient who is the subject of the record or to the
8177 patient, the parent or guardian of the patient if the patient is a
8278 minor or incapacitated, or the personal representative of the
8379 patient if the patient is deceased.
8480 SECTION 2. Section 577.013, Health and Safety Code, is
8581 amended by amending Subsections (d) and (e) and adding Subsections
8682 (f), (g), and (h) to read as follows:
8783 (d) Except as provided by Subsection (e), all [All]
8884 information and materials in the possession of or obtained or
8985 compiled by the commission [department] in connection with a
9086 complaint and investigation concerning a mental hospital licensed
9187 under this chapter are confidential and not subject to disclosure,
9288 discovery, subpoena, or other means of legal compulsion for their
9389 release to anyone other than the commission [department] or its
9490 employees or agents involved in the enforcement action except that
9591 this information may be disclosed to:
9692 (1) persons involved with the commission [department]
9793 in the enforcement action against the licensed mental hospital;
9894 (2) the licensed mental hospital that is the subject
9995 of the enforcement action, or the licensed mental hospital's
10096 authorized representative;
10197 (3) appropriate state or federal agencies that are
10298 authorized to inspect, survey, or investigate licensed mental
10399 hospital services;
104100 (4) law enforcement agencies; and
105101 (5) persons engaged in bona fide research, if all
106102 individual-identifying information and information identifying the
107103 licensed mental hospital has been deleted.
108104 (e) The following information is subject to disclosure in
109105 accordance with Chapter 552 [Section 552.001 et seq.], Government
110106 Code, only to the extent that all personally identifiable
111107 information of a patient or health care provider is omitted from the
112108 information:
113109 (1) a notice of the licensed mental hospital's alleged
114110 violation [against the licensed mental hospital], which must
115111 [notice shall] include the provisions of law [which] the licensed
116112 mental hospital is alleged to have violated, and the nature of the
117113 alleged violation;
118114 (2) the number of investigations the commission has
119115 conducted of the mental hospital;
120116 (3) the pleadings in any [the] administrative
121117 proceeding to impose a penalty against the mental hospital for the
122118 alleged violation;
123119 (4) the outcome of each investigation the commission
124120 conducted of the mental hospital, including:
125121 (A) the issuance of a reprimand;
126122 (B) the denial or revocation of a license;
127123 (C) the adoption of a corrective action plan; or
128124 (D) the imposition of an administrative penalty
129125 and the penalty amount; and
130126 (5) [(3)] a final decision, investigative report, or
131127 order issued by the commission to address the alleged violation
132128 [department].
133129 (f) Not later than the 90th day after the date the
134130 commission issues a final decision, investigative report, or order
135131 to address a mental hospital's alleged violation, the commission
136132 shall post on the commission's Internet website:
137133 (1) the notice of alleged violation described by
138134 Subsection (e)(1);
139135 (2) the name of the mental hospital;
140136 (3) the geographic location of the mental hospital;
141137 (4) the date the commission issued the final decision,
142138 investigative report, or order; and
143139 (5) the outcome of the commission's investigation of
144140 the mental hospital that includes the information described by
145141 Subsection (e)(4).
146142 (g) The commission may not remove information posted on the
147143 commission's Internet website under Subsection (f) before the
148144 second anniversary of the date the information is posted on the
149145 Internet website.
150146 (h) Nothing in this section precludes a mental hospital from
151147 releasing medical records in the mental hospital's possession on
152148 request of the patient who is the subject of the record or to the
153149 patient, the parent or guardian of the patient if the patient is a
154150 minor or incapacitated, or the personal representative of the
155151 patient if the patient is deceased.
156152 SECTION 3. The changes in law made by this Act apply only to
157153 an investigation of an alleged violation by a hospital or mental
158154 hospital that is finalized on or after the effective date of this
159155 Act.
160156 SECTION 4. This Act takes effect September 1, 2021.
