| 7 | 7 | | relating to the expiration of the dry cleaner environmental |
|---|
| 8 | 8 | | response program. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Sections 374.253(a), (b), and (c), Health and |
|---|
| 11 | 11 | | Safety Code, are amended to read as follows: |
|---|
| 12 | 12 | | (a) This chapter expires on September 1, 2041 [2021]. |
|---|
| 13 | 13 | | (b) A corrective action, including any administrative |
|---|
| 14 | 14 | | duties associated with the action, for which remediation of a |
|---|
| 15 | 15 | | contaminated site has begun before September 1, 2041 [2021], shall |
|---|
| 16 | 16 | | be completed in accordance with this chapter using money from the |
|---|
| 17 | 17 | | fund, to the extent possible, but money may not be collected for or |
|---|
| 18 | 18 | | added to the fund on or after that date. |
|---|
| 19 | 19 | | (c) The commission may continue a corrective action that has |
|---|
| 20 | 20 | | not progressed beyond the investigative or planning stage after |
|---|
| 21 | 21 | | September 1, 2041 [2021], to the extent money from the fund is |
|---|
| 22 | 22 | | available. |
|---|
| 23 | 23 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 24 | 24 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 25 | 25 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 26 | 26 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 27 | 27 | | Act takes effect September 1, 2021. |
|---|
