| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter Z, Chapter 212, Local Government |
|---|
| 11 | 11 | | Code, is amended by adding Section 212.906 to read as follows: |
|---|
| 12 | 12 | | Sec. 212.906. PROPERTY OWNERS' ASSOCIATION FINE POLICY. |
|---|
| 13 | 13 | | (a) In this section, "property owners' association" has the |
|---|
| 14 | 14 | | meaning assigned by Section 209.002, Property Code. |
|---|
| 15 | 15 | | (b) A municipality in which a subdivision with a property |
|---|
| 16 | 16 | | owners' association is located shall require the association to |
|---|
| 17 | 17 | | file with the municipality a copy of the policy, and each subsequent |
|---|
| 18 | 18 | | amendment to the policy, regarding the enforcement of fines |
|---|
| 19 | 19 | | assessed by the association. The policy must disclose: |
|---|
| 20 | 20 | | (1) each type of violation for which the board of the |
|---|
| 21 | 21 | | association may assess a fine; |
|---|
| 22 | 22 | | (2) the amount of the fine for each type of violation; |
|---|
| 23 | 23 | | and |
|---|
| 24 | 24 | | (3) pertinent information regarding hearings |
|---|
| 25 | 25 | | described by Section 209.007, Property Code. |
|---|
| 26 | 26 | | (c) A municipality in which a subdivision with a property |
|---|
| 27 | 27 | | owners' association is located shall require the association to |
|---|
| 28 | 28 | | provide a copy of the policy to an owner of each property in the |
|---|
| 29 | 29 | | subdivision by: |
|---|
| 30 | 30 | | (1) posting the policy on an Internet website |
|---|
| 31 | 31 | | maintained by the association; or |
|---|
| 32 | 32 | | (2) annually sending a copy of the policy, separately |
|---|
| 33 | 33 | | or included in routine communication from the association, to each |
|---|
| 34 | 34 | | property owner, by: |
|---|
| 35 | 35 | | (A) hand delivery to the owner; |
|---|
| 36 | 36 | | (B) first class mail to the owner's last known |
|---|
| 37 | 37 | | mailing address; or |
|---|
| 38 | 38 | | (C) e-mail to an e-mail address provided to the |
|---|
| 39 | 39 | | association by the owner. |
|---|
| 40 | 40 | | SECTION 2. This Act takes effect September 1, 2021. |
