44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the prosecution of criminal offenses for violating an
77 emergency management plan.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 418.173, Government Code, is repealed.
1010 SECTION 2. The change in law made by this Act applies to an
1111 offense committed on or after the effective date of this Act and to
1212 any criminal action pending on the effective date of this Act for an
1313 offense committed before that effective date. A final conviction
1414 for an offense under Section 418.173, Government Code, that exists
1515 on the effective date of this Act is unaffected by this Act.
1616 SECTION 3. This Act takes effect immediately if it receives
1717 a vote of two-thirds of all the members elected to each house, as
1818 provided by Section 39, Article III, Texas Constitution. If this
1919 Act does not receive the vote necessary for immediate effect, this
2020 Act takes effect September 1, 2021.
