8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Section 418.173, Government Code, is repealed. | |
10 | 10 | SECTION 2. The change in law made by this Act applies to an | |
11 | 11 | offense committed on or after the effective date of this Act and to | |
12 | 12 | any criminal action pending on the effective date of this Act for an | |
13 | 13 | offense committed before that effective date. A final conviction | |
14 | 14 | for an offense under Section 418.173, Government Code, that exists | |
15 | 15 | on the effective date of this Act is unaffected by this Act. | |
16 | 16 | SECTION 3. This Act takes effect immediately if it receives | |
17 | 17 | a vote of two-thirds of all the members elected to each house, as | |
18 | 18 | provided by Section 39, Article III, Texas Constitution. If this | |
19 | 19 | Act does not receive the vote necessary for immediate effect, this | |
20 | 20 | Act takes effect September 1, 2021. |
