55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the disclosure of personal information associated with
88 a motor vehicle record for certain purposes.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 521.0475(a), Transportation Code, is
1111 amended to read as follows:
1212 (a) Except as provided by Subsection (b), the department
1313 shall provide a certified abstract of a complete driving record of a
1414 license holder, for a fee of $20, to the license holder or a person
1515 eligible to receive the information under Section 730.007(a)
1616 [Sections 730.007(a)(2)(A), (D), and (I)].
1717 SECTION 2. Section 730.007(a), Transportation Code, is
1818 amended to read as follows:
1919 (a) Personal information obtained by an agency in
2020 connection with a motor vehicle record may be disclosed to any
2121 requestor by an agency if the requestor:
2222 (1) provides the requestor's name and address and any
2323 proof of that information required by the agency; and
2424 (2) represents that the use of the personal
2525 information will be strictly limited to:
2626 (A) use by:
2727 (i) a government agency, including any
2828 court or law enforcement agency, in carrying out its functions; or
2929 (ii) a private person or entity acting on
3030 behalf of a government agency in carrying out the functions of the
3131 agency;
3232 (B) [use in connection with a matter of:
3333 [(i) motor vehicle or motor vehicle
3434 operator safety;
3535 [(ii) motor vehicle theft;
3636 [(iii) motor vehicle product alterations,
3737 recalls, or advisories;
3838 [(iv) performance monitoring of motor
3939 vehicles, motor vehicle parts, or motor vehicle dealers;
4040 [(v) motor vehicle market research
4141 activities, including survey research; or
4242 [(vi) removal of nonowner records from the
4343 original owner records of motor vehicle manufacturers;
4444 [(C) use in the normal course of business by a
4545 legitimate business or an authorized agent of the business, but
4646 only:
4747 [(i) to verify the accuracy of personal
4848 information submitted by the individual to the business or the
4949 agent of the business; and
5050 [(ii) if the information is not correct, to
5151 obtain the correct information, for the sole purpose of preventing
5252 fraud by, pursuing a legal remedy against, or recovering on a debt
5353 or security interest against the individual;
5454 [(D)] use in conjunction with a civil, criminal,
5555 administrative, or arbitral proceeding in any court or government
5656 agency or before any self-regulatory body, including service of
5757 process, investigation in anticipation of litigation, execution or
5858 enforcement of a judgment or order, or under an order of any court;
5959 or
6060 (C) [(E) use in research or in producing
6161 statistical reports, but only if the personal information is not
6262 published, redisclosed, or used to contact any individual;
6363 [(F) use by an insurer or insurance support
6464 organization, or by a self-insured entity, or an authorized agent
6565 of the entity, in connection with claims investigation activities,
6666 antifraud activities, rating, or underwriting;
6767 [(G) use in providing notice to an owner of a towed
6868 or impounded vehicle;
6969 [(H) use by a licensed private investigator agency
7070 or licensed security service for a purpose permitted under this
7171 section;
7272 [(I)] use by an employer or an agent or insurer of
7373 the employer to obtain or verify information relating to a holder of
7474 a commercial driver's license that is required under 49 U.S.C.
7575 Chapter 313[;
7676 [(J) use in connection with the operation of a
7777 private toll transportation facility;
7878 [(K) use by a consumer reporting agency, as
7979 defined by the Fair Credit Reporting Act (15 U.S.C. Section 1681 et
8080 seq.), for a purpose permitted under that Act; or
8181 [(L) use for any other purpose specifically
8282 authorized by law that relates to the operation of a motor vehicle
8383 or to public safety].
8484 SECTION 3. Sections 730.007(d) and (e), Transportation
8585 Code, are repealed.
8686 SECTION 4. This Act takes effect September 1, 2021.
