8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Section 364.011(a), Health and Safety Code, is | |
10 | 10 | amended to read as follows: | |
11 | 11 | (a) Subject to [the limitation provided by] Sections | |
12 | 12 | 361.151 and 361.152 [(Solid Waste Disposal Act),] and [subject] to | |
13 | 13 | Subsection (a-1): | |
14 | 14 | (1) [,] a commissioners court of a county with a | |
15 | 15 | population of 500,000 or less by rule may regulate solid waste | |
16 | 16 | collection, handling, storage, and disposal in areas of the county | |
17 | 17 | not in a municipality or the extraterritorial jurisdiction of a | |
18 | 18 | municipality; and | |
19 | 19 | (2) a commissioners court of a county with a | |
20 | 20 | population of more than 500,000 shall regulate solid waste | |
21 | 21 | collection, handling, storage, and disposal in areas of the county | |
22 | 22 | not in a municipality or the extraterritorial jurisdiction of a | |
23 | 23 | municipality. | |
24 | 24 | SECTION 2. This Act takes effect September 1, 2021. |
