55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to failure to identify to a peace officer while carrying
88 certain firearms; creating a criminal offense.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 38.02, Penal Code, is amended by adding
1111 Subsection (b-1) and amending Subsections (c) and (d) to read as
1212 follows:
1313 (b-1) A person commits an offense if the person is carrying
1414 a partially or wholly visible firearm other than a handgun and the
1515 person intentionally:
1616 (1) refuses to give the person's name, residence
1717 address, or date of birth to a peace officer who has requested the
1818 information; or
1919 (2) gives a false or fictitious name, residence
2020 address, or date of birth to a peace officer who has requested the
2121 information.
2222 (c) Except as provided by Subsection [Subsections] (d) [and
2323 (e)], an offense under this section is:
2424 (1) a Class C misdemeanor if the offense is committed
2525 under Subsection (a) or (b-1)(1); or
2626 (2) a Class B misdemeanor if the offense is committed
2727 under Subsection (b) or (b-1)(2).
2828 (d) If it is shown on the trial of an offense under this
2929 section that the defendant was a fugitive from justice at the time
3030 of the offense, the offense is:
3131 (1) a Class B misdemeanor if the offense is committed
3232 under Subsection (a) or (b-1)(1); or
3333 (2) a Class A misdemeanor if the offense is committed
3434 under Subsection (b) or (b-1)(2).
3535 SECTION 2. This Act takes effect September 1, 2021.
