| 8 | 8 | | certain firearms; creating a criminal offense. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 38.02, Penal Code, is amended by adding |
|---|
| 11 | 11 | | Subsection (b-1) and amending Subsections (c) and (d) to read as |
|---|
| 12 | 12 | | follows: |
|---|
| 13 | 13 | | (b-1) A person commits an offense if the person is carrying |
|---|
| 14 | 14 | | a partially or wholly visible firearm other than a handgun and the |
|---|
| 15 | 15 | | person intentionally: |
|---|
| 16 | 16 | | (1) refuses to give the person's name, residence |
|---|
| 17 | 17 | | address, or date of birth to a peace officer who has requested the |
|---|
| 18 | 18 | | information; or |
|---|
| 19 | 19 | | (2) gives a false or fictitious name, residence |
|---|
| 20 | 20 | | address, or date of birth to a peace officer who has requested the |
|---|
| 21 | 21 | | information. |
|---|
| 22 | 22 | | (c) Except as provided by Subsection [Subsections] (d) [and |
|---|
| 23 | 23 | | (e)], an offense under this section is: |
|---|
| 24 | 24 | | (1) a Class C misdemeanor if the offense is committed |
|---|
| 25 | 25 | | under Subsection (a) or (b-1)(1); or |
|---|
| 26 | 26 | | (2) a Class B misdemeanor if the offense is committed |
|---|
| 27 | 27 | | under Subsection (b) or (b-1)(2). |
|---|
| 28 | 28 | | (d) If it is shown on the trial of an offense under this |
|---|
| 29 | 29 | | section that the defendant was a fugitive from justice at the time |
|---|
| 30 | 30 | | of the offense, the offense is: |
|---|
| 31 | 31 | | (1) a Class B misdemeanor if the offense is committed |
|---|
| 32 | 32 | | under Subsection (a) or (b-1)(1); or |
|---|
| 33 | 33 | | (2) a Class A misdemeanor if the offense is committed |
|---|
| 34 | 34 | | under Subsection (b) or (b-1)(2). |
|---|
| 35 | 35 | | SECTION 2. This Act takes effect September 1, 2021. |
