11 | 8 | | relating to school district hearings regarding complaints. |

12 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

13 | 10 | | SECTION 1. Section 11.1511(b), Education Code, is amended |
---|
14 | 11 | | to read as follows: |
---|
15 | 12 | | (b) The board shall: |
---|
16 | 13 | | (1) seek to establish working relationships with other |
---|
17 | 14 | | public entities to make effective use of community resources and to |
---|
18 | 15 | | serve the needs of public school students in the community; |
---|
19 | 16 | | (2) adopt a vision statement and comprehensive goals |
---|
20 | 17 | | for the district and the superintendent and monitor progress toward |
---|
21 | 18 | | those goals; |
---|
22 | 19 | | (3) establish performance goals for the district |
---|
23 | 20 | | concerning: |
---|
24 | 21 | | (A) the academic and fiscal performance |
---|
25 | 22 | | indicators under Subchapters C, D, and J, Chapter 39; and |
---|
26 | 23 | | (B) any performance indicators adopted by the |
---|
27 | 24 | | district; |
---|
28 | 25 | | (4) ensure that the superintendent: |
---|
29 | 26 | | (A) is accountable for achieving performance |
---|
30 | 27 | | results; |
---|
31 | 28 | | (B) recognizes performance accomplishments; and |
---|
32 | 29 | | (C) takes action as necessary to meet performance |
---|
33 | 30 | | goals; |
---|
34 | 31 | | (5) adopt a policy to establish a district- and |
---|
35 | 32 | | campus-level planning and decision-making process as required |
---|
36 | 33 | | under Section 11.251; |
---|
37 | 34 | | (6) publish an annual educational performance report |
---|
38 | 35 | | as required under Section 39.306; |
---|
39 | 36 | | (7) adopt an annual budget for the district as |
---|
40 | 37 | | required under Section 44.004; |
---|
41 | 38 | | (8) adopt a tax rate each fiscal year as required under |
---|
42 | 39 | | Section 26.05, Tax Code; |
---|
43 | 40 | | (9) monitor district finances to ensure that the |
---|
44 | 41 | | superintendent is properly maintaining the district's financial |
---|
45 | 42 | | procedures and records; |
---|
46 | 43 | | (10) ensure that district fiscal accounts are audited |
---|
47 | 44 | | annually as required under Section 44.008; |
---|
48 | 45 | | (11) publish an end-of-year financial report for |
---|
49 | 46 | | distribution to the community; |
---|
50 | 47 | | (12) conduct elections as required by law; |
---|
51 | 48 | | (13) by rule, adopt a process through which district |
---|
52 | 49 | | personnel, students or the parents or guardians of students, and |
---|
53 | 50 | | members of the public may obtain a hearing from the district |
---|
54 | 51 | | administrators and the board regarding a complaint that must: |
---|
55 | 52 | | (A) unless otherwise provided by law, include: |
---|
56 | 53 | | (i) an initial administrative hearing; and |
---|
57 | 54 | | (ii) an opportunity to appeal the |
---|
58 | 55 | | administrative decision following the initial hearing; and |
---|
59 | 56 | | (B) unless otherwise agreed to by the parties, |
---|
60 | 57 | | provide for a resolution of the complaint not later than 120 |
---|
61 | 58 | | calendar days after the date on which the complaint was filed; |
---|
62 | 59 | | (14) make decisions relating to terminating the |
---|
63 | 60 | | employment of district employees employed under a contract to which |
---|
64 | 61 | | Chapter 21 applies, including terminating or not renewing an |
---|
65 | 62 | | employment contract to which that chapter applies; and |
---|
66 | 63 | | (15) carry out other powers and duties as provided by |
---|
67 | 64 | | this code or other law. |
---|
68 | 65 | | SECTION 2. The board of trustees of a school district shall |
---|
69 | 66 | | adopt a process for a hearing in accordance with Section |
---|
70 | 67 | | 11.1511(b), Education Code, as amended by this Act, as soon as |
---|
71 | 68 | | practicable after the effective date of this Act. |
---|
72 | 69 | | SECTION 3. This Act takes effect September 1, 2021. |
