96 A BILL TO BE ENTITLED
107 AN ACT
118 relating to school district hearings regarding complaints.
129 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1310 SECTION 1. Section 11.1511(b), Education Code, is amended
1411 to read as follows:
1512 (b) The board shall:
1613 (1) seek to establish working relationships with other
1714 public entities to make effective use of community resources and to
1815 serve the needs of public school students in the community;
1916 (2) adopt a vision statement and comprehensive goals
2017 for the district and the superintendent and monitor progress toward
2118 those goals;
2219 (3) establish performance goals for the district
2320 concerning:
2421 (A) the academic and fiscal performance
2522 indicators under Subchapters C, D, and J, Chapter 39; and
2623 (B) any performance indicators adopted by the
2724 district;
2825 (4) ensure that the superintendent:
2926 (A) is accountable for achieving performance
3027 results;
3128 (B) recognizes performance accomplishments; and
3229 (C) takes action as necessary to meet performance
3330 goals;
3431 (5) adopt a policy to establish a district- and
3532 campus-level planning and decision-making process as required
3633 under Section 11.251;
3734 (6) publish an annual educational performance report
3835 as required under Section 39.306;
3936 (7) adopt an annual budget for the district as
4037 required under Section 44.004;
4138 (8) adopt a tax rate each fiscal year as required under
4239 Section 26.05, Tax Code;
4340 (9) monitor district finances to ensure that the
4441 superintendent is properly maintaining the district's financial
4542 procedures and records;
4643 (10) ensure that district fiscal accounts are audited
4744 annually as required under Section 44.008;
4845 (11) publish an end-of-year financial report for
4946 distribution to the community;
5047 (12) conduct elections as required by law;
5148 (13) by rule, adopt a process through which district
5249 personnel, students or the parents or guardians of students, and
5350 members of the public may obtain a hearing from the district
5451 administrators and the board regarding a complaint that must:
5552 (A) unless otherwise provided by law, include:
5653 (i) an initial administrative hearing; and
5754 (ii) an opportunity to appeal the
5855 administrative decision following the initial hearing; and
5956 (B) unless otherwise agreed to by the parties,
6057 provide for a resolution of the complaint not later than 120
6158 calendar days after the date on which the complaint was filed;
6259 (14) make decisions relating to terminating the
6360 employment of district employees employed under a contract to which
6461 Chapter 21 applies, including terminating or not renewing an
6562 employment contract to which that chapter applies; and
6663 (15) carry out other powers and duties as provided by
6764 this code or other law.
6865 SECTION 2. The board of trustees of a school district shall
6966 adopt a process for a hearing in accordance with Section
7067 11.1511(b), Education Code, as amended by this Act, as soon as
7168 practicable after the effective date of this Act.
7269 SECTION 3. This Act takes effect September 1, 2021.
