9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 13.002, Property Code, is amended to | |
11 | 11 | read as follows: | |
12 | 12 | Sec. 13.002. EFFECT AND RETENTION OF RECORDED INSTRUMENT. | |
13 | 13 | An instrument that is properly recorded in the proper county [is]: | |
14 | 14 | (1) is notice to all persons of the existence of the | |
15 | 15 | instrument; [and] | |
16 | 16 | (2) is subject to inspection by the public; and | |
17 | 17 | (3) has a permanent record retention period unless a | |
18 | 18 | different retention period for the instrument is provided by a | |
19 | 19 | records retention schedule adopted under Section 441.158, | |
20 | 20 | Government Code, or by other law. | |
21 | 21 | SECTION 2. This Act takes effect immediately if it receives | |
22 | 22 | a vote of two-thirds of all the members elected to each house, as | |
23 | 23 | provided by Section 39, Article III, Texas Constitution. If this | |
24 | 24 | Act does not receive the vote necessary for immediate effect, this | |
25 | 25 | Act takes effect September 1, 2021. |
