136 AN ACT
14- relating to notification by the Department of State Health Services
15- and the Texas Commission on Environmental Quality of incidents of
16- Naegleria fowleri.
7+ relating to notification by the Texas Commission on Environmental
8+ Quality of accidental discharge or spill threatening certain public
9+ water systems.
1710 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
18- SECTION 1. Subchapter D, Chapter 341, Health and Safety
19- Code, is amended by adding Section 341.0646 to read as follows:
20- Sec. 341.0646. NOTIFICATION OF INCIDENTS OF NAEGLERIA
21- FOWLERI. As soon as possible after the department detects or
22- becomes aware of human infection, including primary amebic
23- meningoencephalitis, caused by the presence of the Naegleria
24- fowleri amoeba in a swimming pool, a freshwater lake used for
25- swimming, a public drinking water source, or a park with splashpads
26- or other outdoor features using freshwater for amusement purposes,
27- the department shall notify the Texas Commission on Environmental
28- Quality. The commission shall notify the appropriate public water
29- systems as soon as possible after receiving notice under this
30- section.
11+ SECTION 1. Subchapter B, Chapter 26, Water Code, is amended
12+ by adding Section 26.0395 to read as follows:
13+ Sec. 26.0395. NOTIFICATION OF ACCIDENTAL DISCHARGE OR SPILL
14+ THREATENING CERTAIN PUBLIC WATER SYSTEMS. As soon as possible
15+ after the commission detects or becomes aware of an accidental
16+ discharge or spill that threatens water that is a source for a
17+ public water system and not later than the time the commission
18+ notifies the news media of the accidental discharge or spill, the
19+ commission shall notify the owner or operator of each public water
20+ system that may be threatened by the accidental discharge or spill.
3121 SECTION 2. This Act takes effect immediately if it receives
3222 a vote of two-thirds of all the members elected to each house, as
3323 provided by Section 39, Article III, Texas Constitution. If this
3424 Act does not receive the vote necessary for immediate effect, this
3525 Act takes effect September 1, 2021.
