8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Section 12.051, Utilities Code, is amended to |
---|
10 | 10 | | read as follows: |

11 | 11 | | Section 12.051. APPOINTMENT; TERM. (a) The commission is |
---|
12 | 12 | | composed of five [three] commissioners appointed by the governor |
---|
13 | 13 | | with the advice and consent of the senate. |
---|
14 | 14 | | (b) The members shall be appointed to reflect the diverse |
---|
15 | 15 | | geographic regions and population groups of the state. One member |
---|
16 | 16 | | must reside in a rural area and be a registered voter of a county |
---|
17 | 17 | | with a population of less than 150,000. |
---|
18 | 18 | | (c) [(b)] An appointment to the commission shall be made |
---|
19 | 19 | | without regard to the race, color, disability, sex, religion, age, |
---|
20 | 20 | | or national origin of the appointee. |
---|
21 | 21 | | (d) [(c)] Commissioners serve staggered, six-year terms, |
---|
22 | 22 | | with the terms of one or two members expiring every two years. |
---|
23 | 23 | | SECTION 2. Promptly after this Act takes effect, the |
---|
24 | 24 | | governor shall appoint two additional members to the Public Utility |
---|
25 | 25 | | Commission of Texas. Of those members, the governor shall |
---|
26 | 26 | | designate one to serve a term expiring September 1, 2025, and one to |
---|
27 | 27 | | serve a term expiring September 1, 2027. |
---|
28 | 28 | | SECTION 3. This Act takes effect September 1, 2021. |
