55 AN ACT
66 relating to the membership of the Public Utility Commission of

88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 12.051, Utilities Code, is amended to
1010 read as follows:
1111 Section 12.051. APPOINTMENT; TERM. (a) The commission is
1212 composed of five [three] commissioners appointed by the governor
1313 with the advice and consent of the senate.
1414 (b) The members shall be appointed to reflect the diverse
1515 geographic regions and population groups of the state. One member
1616 must reside in a rural area and be a registered voter of a county
1717 with a population of less than 150,000.
1818 (c) [(b)] An appointment to the commission shall be made
1919 without regard to the race, color, disability, sex, religion, age,
2020 or national origin of the appointee.
2121 (d) [(c)] Commissioners serve staggered, six-year terms,
2222 with the terms of one or two members expiring every two years.
2323 SECTION 2. Promptly after this Act takes effect, the
2424 governor shall appoint two additional members to the Public Utility
2525 Commission of Texas. Of those members, the governor shall
2626 designate one to serve a term expiring September 1, 2025, and one to
2727 serve a term expiring September 1, 2027.
2828 SECTION 3. This Act takes effect September 1, 2021.
