55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the enforcement of commercial motor vehicle safety
88 standards in certain counties.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 644.101(c), Transportation Code, as
1111 amended by Chapters 169 (H.B. 917) and 478 (H.B. 511), Acts of the
1212 86th Legislature, Regular Session, 2019, is reenacted and amended
1313 to read as follows:
1414 (c) A sheriff or a deputy sheriff of any of the following
1515 counties is eligible to apply for certification under this section:
1616 (1) a county bordering the United Mexican States;
1717 (2) a county with a population of less than 1,000, part
1818 of which is located within 75 miles of an international border; [or]
1919 (3) [(2)] a county with a population of 700,000 or
2020 more; [or]
2121 (4) [(3)] a county with a population of 400,000 or
2222 more that borders the county in which the State Capitol is located;
2323 or
2424 (5) a county with a population of more than 40,000 and
2525 less than 300,000 that is adjacent to a county described by
2626 Subdivision (4).
2727 SECTION 2. To the extent of any conflict, this Act prevails
2828 over another Act of the 87th Legislature, Regular Session, 2021,
2929 relating to nonsubstantive additions to and corrections in enacted
3030 codes.
3131 SECTION 3. This Act takes effect immediately if it receives
3232 a vote of two-thirds of all the members elected to each house, as
3333 provided by Section 39, Article III, Texas Constitution. If this
3434 Act does not receive the vote necessary for immediate effect, this
3535 Act takes effect September 1, 2021.
