66 AN ACT
77 relating to the authority of a local government to enter into an
88 intergovernmental support agreement with a branch of the armed
99 forces of the United States.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Title 7, Government Code, is amended by adding
1212 Chapter 793 to read as follows:
1313 CHAPTER 793. INTERGOVERNMENTAL SUPPORT AGREEMENTS
1414 Sec. 793.001. DEFINITION. In this chapter, "local
1515 government" has the meaning assigned by Section 791.003.
1616 Sec. 793.002. AUTHORITY TO ENTER AGREEMENT. In accordance
1717 with the provisions that apply to an interlocal contract under
1818 Chapter 791, a local government may enter into an intergovernmental
1919 support agreement with a branch of the armed forces of the United
2020 States under the National Defense Authorization Act (10 U.S.C.
2121 Section 2679) to provide installation-support services to a
2222 military installation located in this state.
2323 SECTION 2. This Act takes effect immediately if it receives
2424 a vote of two-thirds of all the members elected to each house, as
2525 provided by Section 39, Article III, Texas Constitution. If this
2626 Act does not receive the vote necessary for immediate effect, this
2727 Act takes effect September 1, 2021.
