4	12		AN ACT
5	13		relating to the powers and duties of the Parks and Wildlife
6	14		Department regarding the Texas Water Trust.
7	15		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	16		SECTION 1. Subchapter A, Chapter 12, Parks and Wildlife
9	17		Code, is amended by adding Section 12.028 to read as follows:
10	18		Sec. 12.028. POWERS AND DUTIES REGARDING TEXAS WATER TRUST.
11	19		(a) In this section, "Texas Water Trust" means the trust
12	20		established under Section 15.7031, Water Code.
13	21		(b) Consistent with Section 11.0235(b), Water Code, and the
14	22		department's duties and responsibilities, the department shall
15	23		encourage and facilitate the dedication of water rights in the
16	24		Texas Water Trust through lease, donation, purchase, or other means
17	25		of voluntary transfer for environmental needs, including for the
18	26		purpose of maintaining or improving:
19	27		(1) instream flows;
20	28		(2) water quality;
21	29		(3) fish and wildlife habitat; and
22	30		(4) bay and estuary inflows.
23	31		(c) The department may manage rights in the Texas Water
24	32		Trust in a manner that is consistent with:
25	33		(1) the manner in which a holder of the rights may
26	34		manage the rights;
27	35		(2) the dedication of the rights, including the
28	36		dedication's terms and conditions;
29	37		(3) Sections 11.0237, 11.027, and 11.122, Water Code;
30	38		and
31	39		(4) maximizing environmental benefits.
32	40		(d) This section may not be construed to authorize the
33	41		department to exercise any authority expressly granted to the Texas
34	42		Water Development Board or the Texas Commission on Environmental
35	43		Quality under Subchapter K, Chapter 15, Water Code.
36	44		SECTION 2. Section 15.7031, Water Code, is amended by
37	45		adding Subsection (e) to read as follows:
38	46		(e) The Parks and Wildlife Department may manage rights in
39	47		the trust:
40	48		(1) under a voluntary agreement with a rights holder;
41	49		and
42	50		(2) in the manner described by Section 12.028(c),
43	51		Parks and Wildlife Code.
44	52		SECTION 3. This Act takes effect September 1, 2021.
