55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a local option election to allow the sale of certain
88 alcoholic beverages on Sunday.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 105.01(a), Alcoholic Beverage Code, is
1111 amended to read as follows:
1212 (a) Except as provided in Sections 105.011, 105.02, 105.03,
1313 105.04, and 105.08, no person may sell, offer for sale, or deliver
1414 any liquor:
1515 (1) on New Year's Day, Thanksgiving Day, or Christmas
1616 Day;
1717 (2) on Sunday; or
1818 (3) before 10 a.m. or after 9 p.m. on any other day.
1919 SECTION 2. Chapter 105, Alcoholic Beverage Code, is amended
2020 by adding Section 105.011 to read as follows:
2121 Sec. 105.011. SUNDAY SALE OF LIQUOR IN CERTAIN AREAS. In an
2222 area where the sale on Sunday of liquor for off-premises
2323 consumption has been approved by local option election:
2424 (1) the holder of a package store permit may sell,
2525 offer for sale, or deliver liquor on Sunday between 10 a.m. and 9
2626 p.m.;
2727 (2) the holder of a wholesaler's permit may sell, offer
2828 for sale, or deliver liquor to a retailer anytime on Sunday; and
2929 (3) the holder of a local distributor's permit may
3030 sell, offer for sale, or deliver liquor to a retailer on Sunday
3131 between 5 a.m. and 9 p.m.
3232 SECTION 3. Subchapter B, Chapter 501, Election Code, is
3333 amended by adding Section 501.0351 to read as follows:
3434 Sec. 501.0351. ISSUE ON SUNDAY SALE OF LIQUOR. (a) In an
3535 area where the sale of liquor for off-premise consumption has been
3636 legalized, a local option election may be held to prohibit or
3737 legalize the sale on Sunday of liquor for off-premise consumption.
3838 (b) The ballot shall be prepared to permit voting for or
3939 against the issue: "The sale on Sunday of liquor for off-premise
4040 consumption."
4141 SECTION 4. This Act takes effect September 1, 2021.
