| 7 | 7 | | relating to a local option election to allow the sale of certain |

| 8 | 8 | | alcoholic beverages on Sunday. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 105.01(a), Alcoholic Beverage Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (a) Except as provided in Sections 105.011, 105.02, 105.03, |
|---|
| 13 | 13 | | 105.04, and 105.08, no person may sell, offer for sale, or deliver |
|---|
| 14 | 14 | | any liquor: |
|---|
| 15 | 15 | | (1) on New Year's Day, Thanksgiving Day, or Christmas |
|---|
| 16 | 16 | | Day; |
|---|
| 17 | 17 | | (2) on Sunday; or |
|---|
| 18 | 18 | | (3) before 10 a.m. or after 9 p.m. on any other day. |

| 19 | 19 | | SECTION 2. Chapter 105, Alcoholic Beverage Code, is amended |
|---|
| 20 | 20 | | by adding Section 105.011 to read as follows: |
|---|
| 21 | 21 | | Sec. 105.011. SUNDAY SALE OF LIQUOR IN CERTAIN AREAS. In an |
|---|
| 22 | 22 | | area where the sale on Sunday of liquor for off-premises |
|---|
| 23 | 23 | | consumption has been approved by local option election: |
|---|
| 24 | 24 | | (1) the holder of a package store permit may sell, |
|---|
| 25 | 25 | | offer for sale, or deliver liquor on Sunday between 10 a.m. and 9 |
|---|
| 26 | 26 | | p.m.; |
|---|
| 27 | 27 | | (2) the holder of a wholesaler's permit may sell, offer |
|---|
| 28 | 28 | | for sale, or deliver liquor to a retailer anytime on Sunday; and |
|---|
| 29 | 29 | | (3) the holder of a local distributor's permit may |
|---|
| 30 | 30 | | sell, offer for sale, or deliver liquor to a retailer on Sunday |
|---|
| 31 | 31 | | between 5 a.m. and 9 p.m. |
|---|
| 32 | 32 | | SECTION 3. Subchapter B, Chapter 501, Election Code, is |
|---|
| 33 | 33 | | amended by adding Section 501.0351 to read as follows: |
|---|
| 34 | 34 | | Sec. 501.0351. ISSUE ON SUNDAY SALE OF LIQUOR. (a) In an |
|---|
| 35 | 35 | | area where the sale of liquor for off-premise consumption has been |
|---|
| 36 | 36 | | legalized, a local option election may be held to prohibit or |
|---|
| 37 | 37 | | legalize the sale on Sunday of liquor for off-premise consumption. |
|---|
| 38 | 38 | | (b) The ballot shall be prepared to permit voting for or |
|---|
| 39 | 39 | | against the issue: "The sale on Sunday of liquor for off-premise |
|---|
| 40 | 40 | | consumption." |
|---|
| 41 | 41 | | SECTION 4. This Act takes effect September 1, 2021. |
|---|
