66 AN ACT
77 relating to health benefit plan coverage for colon cancer screening
88 for certain individuals.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 1363.003(a), Insurance Code, is amended
1111 to read as follows:
1212 (a) A health benefit plan that provides coverage for
1313 screening medical procedures must provide [to each individual
1414 enrolled in the plan who is 50 years of age or older and at normal
1515 risk for developing colon cancer] coverage for expenses incurred in
1616 conducting a medically recognized screening examination for the
1717 detection of colorectal cancer to each individual enrolled in the
1818 plan who is 45 years of age or older.
1919 SECTION 2. The change in law made by this Act applies only
2020 to a health benefit plan that is delivered, issued for delivery, or
2121 renewed on or after January 1, 2022. A health benefit plan that is
2222 delivered, issued for delivery, or renewed before January 1, 2022,
2323 is governed by the law as it existed immediately before the
2424 effective date of this Act, and that law is continued in effect for
2525 that purpose.
2626 SECTION 3. This Act takes effect September 1, 2021.
