| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 1363.003(a), Insurance Code, is amended |
|---|
| 11 | 11 | | to read as follows: |
|---|
| 12 | 12 | | (a) A health benefit plan that provides coverage for |
|---|
| 13 | 13 | | screening medical procedures must provide [to each individual |
|---|
| 14 | 14 | | enrolled in the plan who is 50 years of age or older and at normal |
|---|
| 15 | 15 | | risk for developing colon cancer] coverage for expenses incurred in |
|---|
| 16 | 16 | | conducting a medically recognized screening examination for the |
|---|
| 17 | 17 | | detection of colorectal cancer to each individual enrolled in the |
|---|
| 18 | 18 | | plan who is 45 years of age or older. |
|---|
| 19 | 19 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 20 | 20 | | to a health benefit plan that is delivered, issued for delivery, or |
|---|
| 21 | 21 | | renewed on or after January 1, 2022. A health benefit plan that is |
|---|
| 22 | 22 | | delivered, issued for delivery, or renewed before January 1, 2022, |
|---|
| 23 | 23 | | is governed by the law as it existed immediately before the |
|---|
| 24 | 24 | | effective date of this Act, and that law is continued in effect for |
|---|
| 25 | 25 | | that purpose. |

| 26 | 26 | | SECTION 3. This Act takes effect September 1, 2021. |
