410 AN ACT
511 relating to creating a bilingual special education certification to
612 teach students of limited English proficiency with disabilities.
713 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
814 SECTION 1. Subchapter B, Chapter 21, Education Code, is
915 amended by adding Section 21.04891 to read as follows:
1016 Sec. 21.04891. BILINGUAL SPECIAL EDUCATION CERTIFICATION.
1117 (a) In this section, "limited English proficiency" has the meaning
1218 assigned by Section 29.052.
1319 (b) To ensure that there are teachers with special training
1420 in providing instruction to students of limited English proficiency
1521 with disabilities, the board shall establish a bilingual special
1622 education certificate.
1723 (c) To be eligible for a certificate established under this
1824 section, a person must:
1925 (1) satisfactorily complete the coursework for that
2026 certificate in an educator preparation program, including a
2127 skills-based course of instruction on providing instruction to
2228 students of limited English proficiency with disabilities, which
2329 must include instruction on:
2430 (A) the foundations of bilingual, multicultural,
2531 and second language special education;
26- (B) providing individualized education programs
27- for students of limited English proficiency with disabilities;
28- (C) providing assessment of students of limited
29- English proficiency with and without disabilities;
32+ (B) providing culturally responsive
33+ individualized education programs for students of limited English
34+ proficiency with disabilities;
35+ (C) providing assessment for equity and
36+ inclusion of students of limited English proficiency with and
37+ without disabilities;
3038 (D) developing teaching methods to recognize the
3139 intellectual, developmental, and emotional needs of students in
3240 dual language and transitional bilingual education settings;
3341 (E) teaching fundamental academic skills,
3442 including reading, writing, and mathematics, to students of limited
3543 English proficiency; and
36- (F) creating partnerships with families and
37- school professionals;
44+ (F) creating dynamic and collaborative
45+ partnerships with families and school professionals;
3846 (2) perform satisfactorily on a bilingual special
3947 education certificate examination prescribed by the board; and
4048 (3) satisfy any other requirements prescribed by the
4149 board.
4250 SECTION 2. The State Board for Educator Certification shall
4351 propose rules:
4452 (1) establishing requirements and prescribing an
4553 examination for a bilingual special education certificate as
4654 required by Section 21.04891, Education Code, as added by this Act;
4755 and
4856 (2) establishing standards to govern the approval and
4957 renewal of approval of educator preparation programs for bilingual
5058 special education certification.
5159 SECTION 3. This Act takes effect September 1, 2021.
