55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to reporting certain orders and convictions to the
88 Department of Public Safety.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 7B, Code of Criminal
1111 Procedure, is amended by adding Article 7B.0085 to read as follows:
1212 Art. 7B.0085. REPORTING. For an original or modified
1313 protective order issued under this subchapter, on receipt of the
1414 order from the clerk of the court, a law enforcement agency shall
1515 immediately, but not later than 48 hours after the order is
1616 received, enter the information required by Section 411.042(b)(6),
1717 Government Code, into the statewide law enforcement information
1818 system maintained by the Department of Public Safety.
1919 SECTION 2. Subchapter B, Chapter 7B, Code of Criminal
2020 Procedure, is amended by adding Article 7B.054 to read as follows:
2121 Art. 7B.054. REPORTING. For an original or modified
2222 protective order issued under this subchapter, on receipt of the
2323 order from the clerk of the court, a law enforcement agency shall
2424 immediately, but not later than 48 hours after the order is
2525 received, enter the information required by Section 411.042(b)(6),
2626 Government Code, into the statewide law enforcement information
2727 system maintained by the Department of Public Safety.
2828 SECTION 3. Article 17.292(k), Code of Criminal Procedure,
2929 is amended to read as follows:
3030 (k) To ensure that an officer responding to a call is aware
3131 of the existence and terms of an order for emergency protection
3232 issued under this article, not later than 48 hours [the third
3333 business day] after the [date of] receipt of the copy of the order
3434 by the applicable law enforcement agency with jurisdiction over the
3535 municipality or county in which the victim resides, the law
3636 enforcement agency shall enter the information required by [under]
3737 Section 411.042(b)(6), Government Code, into the statewide law
3838 enforcement information system maintained by the Department of
3939 Public Safety.
4040 SECTION 4. Article 66.252, Code of Criminal Procedure, is
4141 amended by amending Subsection (d) and adding Subsection (d-1) to
4242 read as follows:
4343 (d) Except as provided by Subsection (d-1) or (e) or as
4444 otherwise required by applicable state law or rule, information or
4545 data required by this chapter to be reported to the Department of
4646 Public Safety or the Texas Department of Criminal Justice shall be
4747 reported promptly but not later than the 30th day after the date on
4848 which the information or data is received by the agency responsible
4949 for reporting it.
5050 (d-1) A conviction that would prohibit a person from
5151 possessing a firearm under state or federal law shall be reported to
5252 the Department of Public Safety not later than 48 hours after the
5353 judgment of conviction is entered.
5454 SECTION 5. Section 86.0011, Family Code, is amended to read
5555 as follows:
5656 Sec. 86.0011. DUTY TO ENTER INFORMATION INTO STATEWIDE LAW
5757 ENFORCEMENT INFORMATION SYSTEM. [(a)] On receipt of an original or
5858 modified protective order from the clerk of the issuing court, a law
5959 enforcement agency shall immediately, but not later than 48 hours
6060 [the third business day] after [the date] the order is received,
6161 enter the information required by Section 411.042(b)(6),
6262 Government Code, into the statewide law enforcement information
6363 system maintained by the Department of Public Safety.
6464 [(b) In this section, "business day" means a day other than
6565 a Saturday, Sunday, or state or national holiday.]
6666 SECTION 6. The change in law made by this Act applies only
6767 to a protective order, magistrate's order for emergency protection,
6868 or judgment of conviction entered on or after the effective date of
6969 this Act.
7070 SECTION 7. This Act takes effect September 1, 2021.
