|---|
| 9 | 9 | | district and open-enrollment charter school. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter C, Chapter 25, Education Code, is |
|---|
| 12 | 12 | | amended by adding Section 25.0875 to read as follows: |
|---|
| 13 | 13 | | Sec. 25.0875. CERTAIN RELEASES OF STUDENT TO PARENT AFTER |
|---|
| 14 | 14 | | SCHOOL-INITIATED COMMUNICATION PROHIBITED. (a) In this section, |
|---|
| 15 | 15 | | "parent" includes a person standing in parental relation. |
|---|
| 16 | 16 | | (b) Except as provided by Subsection (c), a school district |
|---|
| 17 | 17 | | or open-enrollment charter school may not release a student to the |
|---|
| 18 | 18 | | student's parent before the end of the instructional day and after |
|---|
| 19 | 19 | | the parent receives a school-initiated communication if the release |
|---|
| 20 | 20 | | of the student is: |
|---|
| 21 | 21 | | (1) a disciplinary management technique; or |
|---|
| 22 | 22 | | (2) a reaction to the student's behavior that impedes |
|---|
| 23 | 23 | | the student's ability to learn but does not: |
|---|
| 24 | 24 | | (A) violate the student code of conduct under |
|---|
| 25 | 25 | | Section 37.001; or |
|---|
| 26 | 26 | | (B) require disciplinary action. |
|---|
| 27 | 27 | | (c) A school district or open-enrollment charter school may |
|---|
| 28 | 28 | | release a student to the student's parent before the end of the |
|---|
| 29 | 29 | | instructional day if the student's release occurs because the |
|---|
| 30 | 30 | | student is suspended under Section 37.005 or expelled under Section |
|---|
| 31 | 31 | | 37.0052, 37.007, or 37.0081. |
|---|
| 32 | 32 | | SECTION 2. This Act applies beginning with the 2021-2022 |
|---|
| 33 | 33 | | school year. |
|---|
| 34 | 34 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 35 | 35 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 36 | 36 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 37 | 37 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 38 | 38 | | Act takes effect September 1, 2021. |
