| 10 | 10 | SECTION 1. Chapter 39, Penal Code, is amended by adding | |
| 11 | 11 | Section 39.08 to read as follows: | |
| 12 | 12 | Sec. 39.08. FALSE STATEMENT IN INCIDENT REPORT. (a) A | |
| 13 | 13 | peace officer commits an offense if the officer: | |
| 14 | 14 | (1) files a report with the law enforcement agency | |
| 15 | 15 | employing the officer regarding the commission or investigation of | |
| 16 | 16 | an offense; and | |
| 17 | 17 | (2) intentionally or knowingly makes a false statement | |
| 18 | 18 | in the report. | |
| 19 | 19 | (b) An offense under this section is a Class A misdemeanor. | |
| 20 | 20 | (c) It is an exception to the application of this section | |
| 21 | 21 | that the peace officer attributes the false statement to another | |
| 22 | 22 | person in the report. | |
| 23 | 23 | SECTION 2. This Act takes effect September 1, 2021. |
