9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Subchapter A, Chapter 161, Health and Safety | |
11 | 11 | Code, is amended by adding Section 161.0053 to read as follows: | |
12 | 12 | Sec. 161.0053. IMMUNIZATION RATE TRACKING SYSTEM FOR | |
13 | 13 | LONG-TERM CARE FACILITIES. (a) In this section, "long-term care | |
14 | 14 | facility" means a facility licensed or regulated under Chapter 242, | |
15 | 15 | 247, or 252. | |
16 | 16 | (b) A long-term care facility shall maintain a system to | |
17 | 17 | track the immunization rates of the facility's employees and | |
18 | 18 | residents. The system must include information on: | |
19 | 19 | (1) the aggregate immunization rates of the facility's | |
20 | 20 | employees and residents; and | |
21 | 21 | (2) changes to the aggregate immunization rates | |
22 | 22 | described by Subdivision (1). | |
23 | 23 | (c) A long-term care facility on request shall provide the | |
24 | 24 | immunization rate data described by Subsection (b). The data | |
25 | 25 | provided by the facility may not in any manner identify an employee | |
26 | 26 | or resident. | |
27 | 27 | SECTION 2. This Act takes effect September 1, 2021. |
