411 AN ACT
512 relating to the forfeiture of contraband relating to the criminal
613 offense of racing on a highway.
714 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
815 SECTION 1. (a) Article 59.01(2), Code of Criminal
916 Procedure, as effective until January 1, 2022, is amended to read as
1017 follows:
1118 (2) "Contraband" means property of any nature,
1219 including real, personal, tangible, or intangible, that is:
1320 (A) used in the commission of:
1421 (i) any first or second degree felony under
1522 the Penal Code;
1623 (ii) any felony under Section 15.031(b),
1724 21.11, or 38.04 or Chapter 29, 30, 31, 32, 33, 33A, or 35, Penal
1825 Code;
1926 (iii) any felony under Chapter 43, Penal
2027 Code, except as provided by Paragraph (B);
2128 (iv) any felony under The Securities Act
2229 (Article 581-1 et seq., Vernon's Texas Civil Statutes); or
2330 (v) any offense under Chapter 49, Penal
2431 Code, that is punishable as a felony of the third degree or state
2532 jail felony, if the defendant has been previously convicted three
2633 times of an offense under that chapter;
2734 (B) used or intended to be used in the commission
2835 of:
2936 (i) any felony under Chapter 481, Health
3037 and Safety Code (Texas Controlled Substances Act);
3138 (ii) any felony under Chapter 483, Health
3239 and Safety Code;
3340 (iii) a felony under Chapter 151, Finance
3441 Code;
3542 (iv) any felony under Chapter 20A or 34,
3643 Penal Code;
3744 (v) a Class A misdemeanor under Subchapter
3845 B, Chapter 365, Health and Safety Code, if the defendant has been
3946 previously convicted twice of an offense under that subchapter;
4047 (vi) any felony under Chapter 32, Human
4148 Resources Code, or Chapter 31, 32, 35A, or 37, Penal Code, that
4249 involves a health care program, as defined by Section 35A.01, Penal
4350 Code;
4451 (vii) a Class B misdemeanor under Chapter
4552 522, Business & Commerce Code;
4653 (viii) a Class A misdemeanor under Section
4754 306.051, Business & Commerce Code;
4855 (ix) any offense under Section 42.10, Penal
4956 Code;
5057 (x) any offense under Section 46.06(a)(1)
5158 or 46.14, Penal Code;
5259 (xi) any offense under Chapter 71, Penal
5360 Code;
5461 (xii) any offense under Section 20.05,
5562 20.06, 20.07, 43.04, or 43.05, Penal Code; [or]
5663 (xiii) an offense under Section 326.002,
5764 Business & Commerce Code; or
5865 (xiv) a Class A misdemeanor or any felony
5966 under Section 545.420, Transportation Code, other than a Class A
6067 misdemeanor that is classified as a Class A misdemeanor based
6168 solely on conduct constituting a violation of Subsection (e)(2)(B)
6269 of that section;
6370 (C) the proceeds gained from the commission of a
6471 felony listed in Paragraph (A) or (B) of this subdivision, a
6572 misdemeanor listed in Paragraph (B)(vii), (ix), (x), (xi), or (xii)
6673 of this subdivision, or a crime of violence;
6774 (D) acquired with proceeds gained from the
6875 commission of a felony listed in Paragraph (A) or (B) of this
6976 subdivision, a misdemeanor listed in Paragraph (B)(vii), (ix), (x),
7077 (xi), or (xii) of this subdivision, or a crime of violence;
7178 (E) used to facilitate or intended to be used to
7279 facilitate the commission of a felony under Section 15.031 or
7380 Chapter 43, Penal Code; or
7481 (F) used to facilitate or intended to be used to
7582 facilitate the commission of an offense under Section 20.05, 20.06,
7683 or 20.07 or Chapter 20A, Penal Code.
7784 (b) Article 59.01(2), Code of Criminal Procedure, as
7885 effective on January 1, 2022, is amended to read as follows:
7986 (2) "Contraband" means property of any nature,
8087 including real, personal, tangible, or intangible, that is:
8188 (A) used in the commission of:
8289 (i) any first or second degree felony under
8390 the Penal Code;
8491 (ii) any felony under Section 15.031(b),
8592 21.11, or 38.04 or Chapter 29, 30, 31, 32, 33, 33A, or 35, Penal
8693 Code;
8794 (iii) any felony under Chapter 43, Penal
8895 Code, except as provided by Paragraph (B);
8996 (iv) any felony under The Securities Act
9097 (Title 12, Government Code); or
9198 (v) any offense under Chapter 49, Penal
9299 Code, that is punishable as a felony of the third degree or state
93100 jail felony, if the defendant has been previously convicted three
94101 times of an offense under that chapter;
95102 (B) used or intended to be used in the commission
96103 of:
97104 (i) any felony under Chapter 481, Health
98105 and Safety Code (Texas Controlled Substances Act);
99106 (ii) any felony under Chapter 483, Health
100107 and Safety Code;
101108 (iii) a felony under Chapter 151, Finance
102109 Code;
103110 (iv) any felony under Chapter 20A or 34,

105112 (v) a Class A misdemeanor under Subchapter
106113 B, Chapter 365, Health and Safety Code, if the defendant has been
107114 previously convicted twice of an offense under that subchapter;

133140 misdemeanor listed in Paragraph (B)(vii), (ix), (x), (xi), or (xii)
134141 of this subdivision, or a crime of violence;
135142 (D) acquired with proceeds gained from the
136143 commission of a felony listed in Paragraph (A) or (B) of this
137144 subdivision, a misdemeanor listed in Paragraph (B)(vii), (ix), (x),
138145 (xi), or (xii) of this subdivision, or a crime of violence;
139146 (E) used to facilitate or intended to be used to
140147 facilitate the commission of a felony under Section 15.031 or
141148 Chapter 43, Penal Code; or
142149 (F) used to facilitate or intended to be used to
143150 facilitate the commission of an offense under Section 20.05, 20.06,
144151 or 20.07 or Chapter 20A, Penal Code.
145152 SECTION 2. The change in law made by this Act applies only
146153 to property or proceeds seized on or after the effective date of
147154 this Act. Property or proceeds seized before the effective date of
148155 this Act are governed by the law in effect on the date the property
149156 or proceeds were seized, and the former law is continued in effect
150157 for that purpose. For purposes of this section, property or
151158 proceeds were seized before the effective date of this Act if any
152159 portion of the property or proceeds were seized before that date.
153160 SECTION 3. This Act takes effect September 1, 2021.
