55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the qualifications required to hold the office of
88 constable.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 86.0021(a), Local Government Code, is
1111 amended to read as follows:
1212 (a) A person is not eligible to serve as constable unless:
1313 (1) the person is eligible to be licensed under
1414 Sections 1701.309 and 1701.312, Occupations Code, and:
1515 (A) [has at least an associate's degree conferred
1616 by an institution of higher education accredited by an accrediting
1717 organization recognized by the Texas Higher Education Coordinating
1818 Board;
1919 [(B)] is a special investigator under Article
2020 2.122(a), Code of Criminal Procedure; or
2121 (B) [(C)] is an honorably retired peace officer
2222 or honorably retired federal criminal investigator who holds a
2323 certificate of proficiency issued under Section 1701.357,
2424 Occupations Code; or
2525 (2) the person is an active or inactive licensed peace
2626 officer under Chapter 1701, Occupations Code.
2727 SECTION 2. The change in law made by this Act applies only
2828 to a constable elected or appointed to serve a term of office that
2929 begins on or after the effective date of this Act. A constable
3030 serving a term of office that began before the effective date of
3131 this Act is governed for the remainder of that term by the
3232 applicable law that existed immediately before the effective date
3333 of this Act, and the former law is continued in effect for that
3434 purpose.
3535 SECTION 3. This Act takes effect September 1, 2021.
