55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the use of information from the lists of noncitizens and
88 nonresidents excused or disqualified from jury service.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 18.068(a), Election Code, is amended to
1111 read as follows:
1212 (a) The secretary of state shall quarterly compare the
1313 information received under Section 16.001 of this code and Sections
1414 [Section] 62.113 and 62.114, Government Code, to the statewide
1515 computerized voter registration list. If the secretary determines
1616 that a voter on the registration list is deceased or has been
1717 excused or disqualified from jury service because the voter is not a
1818 citizen or a resident of the county in which the voter is registered
1919 to vote, the secretary shall send notice of the determination to:
2020 (1) the voter registrar of the counties considered
2121 appropriate by the secretary; and
2222 (2) the attorney general, who shall quarterly review
2323 the information to investigate whether a person has committed an
2424 offense under Section 13.007 or other law.
2525 SECTION 2. Section 62.113(b), Government Code, is amended
2626 to read as follows:
2727 (b) On the third business day of each month, the clerk shall
2828 send a copy of the list of persons excused or disqualified because
2929 of citizenship in the previous month to:
3030 (1) the voter registrar of the county;
3131 (2) the secretary of state; and
3232 (3) the county or district attorney, as applicable, or
3333 the attorney general for an investigation of whether the person
3434 committed an offense under Section 13.007, Election Code, or other
3535 law.
3636 SECTION 3. Sections 62.114(b) and (c), Government Code, are
3737 amended to read as follows:
3838 (b) On the third business day of each month, the clerk shall
3939 send [to the voter registrar of the county] a copy of the list of
4040 persons excused or disqualified in the previous month because the
4141 persons do not reside in the county to:
4242 (1) the voter registrar of the county;
4343 (2) the secretary of state; and
4444 (3) the county or district attorney, as applicable, or
4545 the attorney general for an investigation of whether the person
4646 committed an offense under Section 13.007, Election Code, or other
4747 law.
4848 (c) A list compiled under this section may not be used for a
4949 purpose other than a purpose described by Subsection (b) or Section
5050 15.081 or 18.068, Election Code.
5151 SECTION 4. This Act takes effect immediately if it receives
5252 a vote of two-thirds of all the members elected to each house, as
5353 provided by Section 39, Article III, Texas Constitution. If this
5454 Act does not receive the vote necessary for immediate effect, this
5555 Act takes effect September 1, 2021.
