| 5 | 12 | | relating to the purchase of food and beverages by the Department of |

| 6 | 13 | | Public Safety for certain persons. |

| 7 | 14 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 15 | | SECTION 1. Section 411.0132, Government Code, is amended to |
|---|
| 9 | 16 | | read as follows: |
|---|
| 10 | 17 | | Sec. 411.0132. USE OF FUNDS TO SUPPORT CERTAIN PERSONS |
|---|
| 11 | 18 | | [PEACE OFFICER TRAINING]. The department[, subject to director |
|---|
| 12 | 19 | | approval,] may use appropriated funds to purchase food and |
|---|
| 13 | 20 | | beverages for: |
|---|
| 14 | 21 | | (1) training functions required of peace officers of |
|---|
| 15 | 22 | | the department subject to director approval; and |
|---|
| 16 | 23 | | (2) a person who is: |
|---|
| 17 | 24 | | (A) activated to provide services in response to |
|---|
| 18 | 25 | | an emergency situation, incident, or disaster; and |
|---|
| 19 | 26 | | (B) unable to leave or required to remain at the |
|---|
| 20 | 27 | | person's assignment area due to the emergency situation, incident, |
|---|
| 21 | 28 | | or disaster. |
|---|
| 22 | 29 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 23 | 30 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 24 | 31 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 25 | 32 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 26 | 33 | | Act takes effect September 1, 2021. |
