8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Subchapter A, Chapter 85, Election Code, is | |
10 | 10 | amended by adding Section 85.0055 to read as follows: | |
11 | 11 | Sec. 85.0055. VOTING AFTER POLLS CLOSE. (a) A voter who | |
12 | 12 | has not voted before the time for closing an early voting polling | |
13 | 13 | place is entitled to vote after that time if the voter is inside or | |
14 | 14 | waiting to enter the polling place at closing time. | |
15 | 15 | (b) If voters are waiting to enter the polling place at | |
16 | 16 | closing time, the presiding judge shall direct them to enter the | |
17 | 17 | polling place and shall close it to others. However, if that | |
18 | 18 | procedure is impracticable, at closing time the presiding judge | |
19 | 19 | shall distribute numbered identification cards to the waiting | |
20 | 20 | voters and permit entry into the polling place for voting after | |
21 | 21 | closing time only by those possessing a card. | |
22 | 22 | (c) The presiding judge shall take the precautions | |
23 | 23 | necessary to prevent voting after closing time by persons who are | |
24 | 24 | not entitled to do so. | |
25 | 25 | SECTION 2. This Act takes effect September 1, 2021. |
