55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the creation of a task force to study the legal and
88 societal barriers to equality for persons who are transgender.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. (a) In this section, "task force" means the
1111 transgender equality task force.
1212 (b) The task force is established to study the legal and
1313 societal barriers to equality for persons in this state who are
1414 transgender.
1515 (c) The task force is composed of:
1616 (1) 11 members appointed by the governor as follows:
1717 (A) one representative of the Texas Department of
1818 Banking;
1919 (B) one representative of the Texas Department of
2020 Criminal Justice;
2121 (C) one representative of the Department of
2222 Family and Protective Services;
2323 (D) one representative of the Texas Department of
2424 Insurance;
2525 (E) one representative of the Department of State
2626 Health Services;
2727 (F) one representative of the Texas Education
2828 Agency;
2929 (G) one representative of the Health and Human
3030 Services Commission;
3131 (H) one representative of an institution of
3232 higher education;
3333 (I) one representative of the Texas Workforce
3434 Commission civil rights division;
3535 (J) one representative of the Texas Workforce
3636 Commission division of workforce development; and
3737 (K) one representative of a nonprofit
3838 organization dedicated to civil rights;
3939 (2) two members appointed by the lieutenant governor
4040 as follows:
4141 (A) a parent or guardian of a person who is
4242 transgender; and
4343 (B) an attorney who specializes in transgender
4444 rights; and
4545 (3) two members appointed by the speaker of the house
4646 of representatives as follows:
4747 (A) a physician who specializes in transgender
4848 health issues; and
4949 (B) one person who is transgender.
5050 (d) The task force shall hold its first meeting not later
5151 than October 1, 2021, and shall elect a presiding officer from among
5252 its membership. The task force shall hold subsequent meetings at
5353 least quarterly at the call of the presiding officer.
5454 (e) A task force member is not entitled to compensation for
5555 service on the task force but is entitled to reimbursement for
5656 actual and necessary expenses incurred in performing task force
5757 duties. The task force may accept gifts, grants, and donations to
5858 pay for those expenses.
5959 (f) The Texas Workforce Commission civil rights division
6060 shall provide administrative support services at the request of the
6161 task force.
6262 (g) The task force shall study the state actions necessary
6363 to ensure equality and improve the lives of persons who are
6464 transgender, with particular attention to the following areas:
6565 (1) health care, including access to health care
6666 providers who are trained in transgender medical issues;
6767 (2) long-term care for persons who are transgender and
6868 chronically ill or of advanced age;
6969 (3) education;
7070 (4) higher education;
7171 (5) housing, including homelessness prevention and
7272 reduction;
7373 (6) employment; and
7474 (7) criminal justice, including the following:
7575 (A) raising transgender awareness among law
7676 enforcement through training; and
7777 (B) facilitating the appropriate placement of
7878 persons who are transgender in correctional facilities based on a
7979 person's gender identity.
8080 (h) A state agency shall cooperate with and assist the task
8181 force in carrying out the duties of the task force.
8282 (i) Not later than December 1, 2022, the task force shall
8383 prepare and submit to the governor and the legislature a written
8484 report that summarizes the task force's findings under this section
8585 and recommends solutions for advancing transgender equality and
8686 improving the lives of persons in this state who are transgender.
8787 (j) The task force is abolished and this Act expires
8888 September 1, 2023.
8989 SECTION 2. This Act takes effect September 1, 2021.
