129 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1310 SECTION 1. Section 501.015(a), Government Code, is amended
1411 to read as follows:
1512 (a) When an inmate is discharged or is released on parole,
1613 mandatory supervision, or conditional pardon, the department shall
1714 provide the inmate with:
1815 (1) suitable civilian clothing;
1916 (2) money held in the inmate's trust account by the
2017 director;
2118 (3) cash, in an amount and in the manner described by
2219 Subsection (b); and
2320 (4) a license or personal identification certificate
2421 obtained under Section 501.0165, if available.
25- SECTION 2. Sections 501.0165(a), (b), (c), and (d),
26- Government Code, are amended to read as follows:
22+ SECTION 2. Section 501.0165, Government Code, is amended by
23+ amending Subsections (a), (b), and (c) and adding Subsection (b-1)
24+ to read as follows:
2725 (a) Before discharging an inmate or releasing an inmate on
2826 parole, mandatory supervision, or conditional pardon, the
2927 department shall:
3028 (1) determine whether the inmate has:
3129 (A) a valid license issued under Chapter 521 or
3230 522, Transportation Code; or
3331 (B) a valid personal identification certificate
3432 issued under Chapter 521, Transportation Code; and
3533 (2) if the inmate does not have a valid license or
3634 certificate described by Subdivision (1), submit to the Department
3735 of Public Safety on behalf of the inmate a request for the issuance
3836 of:
3937 (A) a renewal license under Chapter 521 or 522,
4038 Transportation Code, if:
4139 (i) the inmate's license issued under the
4240 applicable chapter is expired but eligible for renewal; and
4341 (ii) the inmate meets the requirements for
4442 the issuance of the license; or
4543 (B) a personal identification certificate under
4644 Chapter 521, Transportation Code.
4745 (b) The department shall submit a request under Subsection
4846 (a)(2) as soon as is practicable to enable the department to provide
4947 the inmate with the license or personal identification certificate
5048 when the department discharges or releases the inmate.
49+ (b-1) Notwithstanding any other law, a license or personal
50+ identification certificate issued to an inmate under Subsection
51+ (a)(2) may include in lieu of the inmate's current residence
52+ address the inmate's intended residence address after discharge or
53+ release. The department and the Department of Public Safety shall
54+ ensure that a license or personal identification certificate issued
55+ to an inmate under Subsection (a)(2) includes the inmate's intended
56+ residence address unless that address is unknown.
5157 (c) The department, the Department of Public Safety, and the
5258 [bureau of] vital statistics unit of the Department of State Health
5359 Services shall by rule adopt a memorandum of understanding that
5460 establishes their respective responsibilities with respect to the
5561 issuance of a license or personal identification certificate to an
5662 inmate under this section, including responsibilities related to
5763 verification of the inmate's identity. The memorandum of
5864 understanding must require the Department of State Health Services
5965 to electronically verify the birth record of an inmate whose name
6066 and any other personal information is provided by the department
6167 and to electronically report the recorded filing information to the
6268 Department of Public Safety to validate the identity of an inmate
6369 under this section.
64- (d) The department shall reimburse the Department of Public
65- Safety or the Department of State Health Services for the actual
66- costs incurred by those agencies in performing responsibilities
67- established under this section. The department may charge an
68- inmate for the actual costs incurred under this section or the fees
69- required by Section 521.421 or 522.029, Transportation Code, as
70- applicable.
71- SECTION 3. Section 521.421(a-1), Transportation Code, is
72- amended to read as follows:
73- (a-1) The fee for a renewal driver's license or a personal
74- identification certificate issued under Section 501.0165,
75- Government Code, or Section 841.153, Health and Safety Code, as
76- applicable, is $5.
77- SECTION 4. Section 522.029, Transportation Code, is amended
78- by amending Subsection (a) and adding Subsection (n) to read as
79- follows:
80- (a) The fee for a commercial driver's license issued by the
81- department is $96, except as provided by Subsections (f), (h), (j),
82- (k), [and] (m), and (n).
83- (n) The fee for a renewal commercial driver's license issued
84- under Section 501.0165, Government Code, is $5.
85- SECTION 5. As soon as practicable after the effective date

71+ amended by adding Section 501.0167 to read as follows:
72+ Sec. 501.0167. PROVIDING DISCHARGED OR RELEASED INMATE WITH
73+ INFORMATION ON VOTING. When an inmate is discharged or is released
74+ on parole, mandatory supervision, or conditional pardon, the
75+ department shall provide the inmate with a document explaining the
76+ procedure for restoring the inmate's eligibility to register to
77+ vote after a felony conviction in accordance with Section
78+ 13.001(a)(4), Election Code.
79+ SECTION 4. As soon as practicable after the effective date
8680 of this Act, the Texas Department of Criminal Justice, the
8781 Department of Public Safety of the State of Texas, and the vital
8882 statistics unit of the Department of State Health Services shall
8983 update as necessary the memorandum of understanding and rules
9084 required by Section 501.0165(c), Government Code, as amended by
9185 this Act.
92- SECTION 6. The change in law made by this Act applies only
86+ SECTION 5. The change in law made by this Act applies only
9387 to the discharge or release of an inmate on parole, mandatory
9488 supervision, or conditional pardon that occurs on or after December
9589 1, 2021. A discharge or release that occurs before that date is
9690 governed by the law in effect immediately before the effective date
9791 of this Act, and the former law is continued in effect for that
9892 purpose.
99- SECTION 7. This Act takes effect September 1, 2021.
93+ SECTION 6. This Act takes effect September 1, 2021.
