55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the computation of unemployment compensation benefits
88 for an individual who is totally unemployed in a benefit period.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 207.002(a), (b), and (c-1), Labor Code,
1111 are amended to read as follows:
1212 (a) An eligible individual who is totally unemployed in a
1313 benefit period is entitled to benefits for the benefit period at the
1414 rate of 2/43 [1/25] of the wages received by the individual from
1515 employment by employers during that quarter in the individual's
1616 base period in which wages were highest. For purposes of this
1717 subsection, the wages received by the individual from employment by
1818 employers during the individual's base period include wages ordered
1919 to be paid to the individual by a final order of the commission
2020 under Chapter 61 that:
2121 (1) were due to be paid to the individual by an
2222 employer during the individual's base period; and
2323 (2) will be credited to the date or dates on which the
2424 payment of those wages was due.
2525 (b) The maximum weekly benefit amount is 60 [47.6] percent
2626 of the average weekly wage in covered employment in this state. The
2727 minimum weekly benefit amount is 15 [7.6] percent of the average
2828 weekly wage in covered employment in this state.
2929 (c-1) An increase in the maximum weekly benefit amount may
3030 not exceed $14 in any year. An increase in the minimum weekly
3131 benefit amount may not exceed $1 in any year. The limitations
3232 prescribed by this subsection apply only to an increase that is
3333 caused solely by an increase in the average weekly wage in covered
3434 employment in this state.
3535 SECTION 2. The changes in law made by this Act apply only to
3636 a claim for unemployment compensation benefits filed with the Texas
3737 Workforce Commission on or after the effective date of this Act. A
3838 claim filed before the effective date of this Act is governed by the
3939 law in effect on the date the claim was filed, and the former law is
4040 continued in effect for that purpose.
4141 SECTION 3. This Act takes effect October 1, 2021.
