| 11 | 13 | | SECTION 1. The heading to Section 191.010, Local Government |

| 12 | 14 | | Code, is amended to read as follows: |

| 15 | 17 | | SECTION 2. Section 191.010, Local Government Code, is |

| 16 | 18 | | amended by amending Subsection (b) and adding Subsection (b-1) to |

| 17 | 19 | | read as follows: |

| 18 | 20 | | (b) A county clerk [in a county with a population of 3.3 |

| 19 | 21 | | million or more] may require a person presenting a document in |
|---|
| 20 | 22 | | person for filing in the real property records of the county to |
|---|
| 21 | 23 | | present a photo identification to the clerk. The clerk may copy the |
|---|
| 22 | 24 | | photo identification or record information from the photo |
|---|
| 23 | 25 | | identification. The clerk may not charge a person a fee to copy or |
|---|
| 24 | 26 | | record the information from a photo identification. |
|---|
| 25 | 27 | | (b-1) A county clerk that requires a person to present photo |
|---|
| 26 | 28 | | identification under Subsection (b) may not accept a document for |
|---|
| 27 | 29 | | filing in the real property records of the county if the person |
|---|
| 28 | 30 | | presents the document in person and does not have or refuses to |
|---|
| 29 | 31 | | provide a photo identification. |

| 30 | 32 | | SECTION 3. This Act takes effect September 1, 2021. |
