55 AN ACT
66 relating to the authority of the Texas Commission on Environmental
77 Quality to require water pollution abatement plans from certain
88 facilities regulated by the Railroad Commission of Texas.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 26, Water Code, is amended
1111 by adding Section 26.0462 to read as follows:
1212 Sec. 26.0462. EDWARDS AQUIFER PLANS ASSOCIATED WITH OIL,
1313 GAS, OR GEOTHERMAL RESOURCES. Notwithstanding another provision of
1414 this chapter or a provision of the Natural Resources Code, the
1515 commission may require the owner or operator of a facility used in
1616 connection with an activity that is associated with the
1717 exploration, development, or production of oil, gas, or geothermal
1818 resources and regulated by the Railroad Commission of Texas to
1919 submit to the commission a water pollution abatement plan for the
2020 facility if the facility is located in the recharge zone of the
2121 Edwards Aquifer, as defined by commission rule.
2222 SECTION 2. This Act takes effect September 1, 2021.
