9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Subchapter B, Chapter 26, Water Code, is amended | |
11 | 11 | by adding Section 26.0462 to read as follows: | |
12 | 12 | Sec. 26.0462. EDWARDS AQUIFER PLANS ASSOCIATED WITH OIL, | |
13 | 13 | GAS, OR GEOTHERMAL RESOURCES. Notwithstanding another provision of | |
14 | 14 | this chapter or a provision of the Natural Resources Code, the | |
15 | 15 | commission may require the owner or operator of a facility used in | |
16 | 16 | connection with an activity that is associated with the | |
17 | 17 | exploration, development, or production of oil, gas, or geothermal | |
18 | 18 | resources and regulated by the Railroad Commission of Texas to | |
19 | 19 | submit to the commission a water pollution abatement plan for the | |
20 | 20 | facility if the facility is located in the recharge zone of the | |
21 | 21 | Edwards Aquifer, as defined by commission rule. | |
22 | 22 | SECTION 2. This Act takes effect September 1, 2021. |
