66 AN ACT
77 relating to the regulation of aggregate production operations by
88 the commissioners court in certain counties.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. The heading to Chapter 28A, Water Code, is
1111 amended to read as follows:
1212 CHAPTER 28A. REGULATION [REGISTRATION AND INSPECTION] OF CERTAIN
1313 AGGREGATE PRODUCTION OPERATIONS
1414 SECTION 2. Section 28A.001(1), Water Code, is amended to
1515 read as follows:
1616 (1) "Aggregate production operation" means the site
1717 from which aggregates are being or have been removed or extracted
1818 from the earth, including the entire areas of extraction, stripped
1919 areas, haulage ramps, and the land on which the plant processing the
2020 raw materials is located, exclusive of any land owned or leased by
2121 the responsible party not being currently used in the production of
2222 aggregates. For the purposes of this chapter, the term "aggregate
2323 production operation" includes a quarry producing aggregates. For
2424 the purposes of this chapter, the term "aggregate production
2525 operation" does not include:
2626 (A) a site at which the materials that are being
2727 removed or extracted from the earth are used or processed at the
2828 same site or at a related site under the control of the same
2929 responsible party for the production of cement or lightweight
3030 aggregates, or in a lime kiln;
3131 (B) a temporary site that is being used solely to
3232 provide aggregate products for use in a public works project
3333 involving the Texas Department of Transportation or a local
3434 governmental entity;
3535 (C) an extraction area from which all raw
3636 material is extracted for use as fill or for other construction uses
3737 at the same or a contiguous site;
3838 (D) a site at which the materials that are being
3939 removed or extracted from the earth are used or processed for use in
4040 the construction, modification, or expansion of a solid waste
4141 facility at the site or another location; or
4242 (E) a site at which:
4343 (i) the materials being removed or
4444 extracted from the earth are specialty or terrazzo-type
4545 [terrazo-type] stone removed or extracted exclusively for
4646 decorative or artistic uses; and
4747 (ii) the portion of the specialty or
4848 terrazzo-type [terrazo-type] stone horizon that is exposed for
4949 current production for commercial sale in the site does not exceed
5050 five acres.
5151 SECTION 3. The heading to Subchapter B, Chapter 28A, Water
5252 Code, is amended to read as follows:
5353 SUBCHAPTER B. REGISTRATION, [AND] INSPECTION, AND OPERATION
5454 SECTION 4. Subchapter B, Chapter 28A, Water Code, is
5555 amended by adding Section 28A.055 to read as follows:
5656 Sec. 28A.055. LOCATION OF AGGREGATE PRODUCTION OPERATIONS
5757 IN CERTAIN COUNTIES. (a) This section applies only to:
5858 (1) a county with a population of 500,000 or more; or
5959 (2) a county that:
6060 (A) is adjacent to a county with a population of
6161 500,000 or more; and
6262 (B) according to the most recent federal
6363 decennial census, had population growth of more than 30 percent
6464 during the decade preceding the most recent federal decennial
6565 census.
6666 (b) The county commissioners court by order may prohibit the
6767 construction or expansion of an aggregate production operation at a
6868 location less than one mile from a residence, school, place of
6969 worship, hospital, or land platted for residential development and
7070 may establish conditions on the construction or expansion of an
7171 aggregate production operation for other locations in the county
7272 based on development patterns of the county, distance of an
7373 operation from a roadway, traffic conditions, emission of dust from
7474 an operation, or public safety.
7575 (c) An order adopted under this section may not result in a
7676 prohibition on the construction or expansion of aggregate
7777 production operations in the county.
7878 SECTION 5. The changes in law made by this Act apply only to
7979 the construction or expansion of an aggregate production operation
8080 that begins on or after the effective date of this Act. The
8181 construction or expansion of an aggregate production operation that
8282 begins before the effective date of this Act is governed by the law
8383 in effect immediately before the effective date of this Act, and the
8484 former law is continued in effect for that purpose.
8585 SECTION 6. This Act takes effect September 1, 2021.
