4	10		AN ACT
5	11		relating to the mileage expense reimbursement for certain temporary
6	12		justices of the peace.
7	13		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	14		SECTION 1. Section 27.055(b), Government Code, is amended
9	15		to read as follows:
10	16		(b) If a justice is temporarily unable to perform official
11	17		duties because of absence, recusal, illness, injury, or other
12	18		disability, the county judge, on the judge's own motion or at the
13	19		request of the justice of the peace, may appoint a qualified person
14	20		to serve as temporary justice for the duration of the absence of the
15	21		justice of the peace from the bench. The commissioners court shall
16	22		compensate the temporary justice by the day, week, or month in an
17	23		amount equal to the compensation of the regular justice. If the
18	24		temporary justice is also serving as a justice of the peace in
19	25		another justice precinct in the county, the commissioners court may
20	26		authorize reimbursement for the mileage expenses incurred in
21	27		performing the official duties of the temporary justice's
22	28		appointment, notwithstanding Chapter 152, Local Government Code. A
23	29		temporary justice has all the rights and powers of the justice of
24	30		the peace while serving in that capacity but may not make personnel
25	31		decisions about, or significant changes in, the justice of the
26	32		peace's office.
27	33		SECTION 2. This Act takes effect September 1, 2021.
