410 AN ACT
511 relating to the mileage expense reimbursement for certain temporary
612 justices of the peace.
713 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
814 SECTION 1. Section 27.055(b), Government Code, is amended
915 to read as follows:
1016 (b) If a justice is temporarily unable to perform official
1117 duties because of absence, recusal, illness, injury, or other
1218 disability, the county judge, on the judge's own motion or at the
1319 request of the justice of the peace, may appoint a qualified person
1420 to serve as temporary justice for the duration of the absence of the
1521 justice of the peace from the bench. The commissioners court shall
1622 compensate the temporary justice by the day, week, or month in an
1723 amount equal to the compensation of the regular justice. If the
1824 temporary justice is also serving as a justice of the peace in
1925 another justice precinct in the county, the commissioners court may
2026 authorize reimbursement for the mileage expenses incurred in
2127 performing the official duties of the temporary justice's
2228 appointment, notwithstanding Chapter 152, Local Government Code. A
2329 temporary justice has all the rights and powers of the justice of
2430 the peace while serving in that capacity but may not make personnel
2531 decisions about, or significant changes in, the justice of the
2632 peace's office.
2733 SECTION 2. This Act takes effect September 1, 2021.
