9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Chapter 511, Government Code, is amended by |
---|
11 | 11 | | adding Section 511.023 to read as follows: |
---|
12 | 12 | | Sec. 511.023. INTAKE OF PERSONS WITH INTELLECTUAL OR |
---|
13 | 13 | | DEVELOPMENTAL DISABILITIES. (a) The commission shall: |
---|
14 | 14 | | (1) monitor the intake processes in county jails to |
---|
15 | 15 | | assess each county jail's ability to properly identify persons with |
---|
16 | 16 | | intellectual or developmental disabilities; and |
---|
17 | 17 | | (2) assist county jails in improving the intake |
---|
18 | 18 | | processes with respect to persons with intellectual or |
---|
19 | 19 | | developmental disabilities. |
---|
20 | 20 | | (b) Not later than December 1, 2022, the commission shall |
---|
21 | 21 | | prepare and submit a report to the governor, the lieutenant |
---|
22 | 22 | | governor, the speaker of the house of representatives, each |
---|
23 | 23 | | standing committee of the legislature with primary jurisdiction |
---|
24 | 24 | | over the commission, and each sheriff that includes: |
---|
25 | 25 | | (1) a discussion of any deficiencies in the intake |
---|
26 | 26 | | processes that have been identified by the commission; and |
---|
27 | 27 | | (2) recommendations to improve county jail practices |
---|
28 | 28 | | regarding identifying persons with intellectual or developmental |
---|
29 | 29 | | disabilities. |
---|
30 | 30 | | (c) This subsection and Subsection (b) expire January 1, |
---|
31 | 31 | | 2023. |
---|
32 | 32 | | SECTION 2. This Act takes effect September 1, 2021. |
