| 13 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 14 | 9 | SECTION 1. Section 31.003, Parks and Wildlife Code, is | |
| 15 | 10 | amended by adding Subdivision (19) to read as follows: | |
| 16 | 11 | (19) "Antique outboard motor" means an outboard motor | |
| 17 | 12 | that is at least 40 years of age. | |
| 18 | 13 | SECTION 2. Section 31.055, Parks and Wildlife Code, is | |
| 19 | 14 | amended to read as follows: | |
| 20 | 15 | Sec. 31.055. EXCEPTIONS. This subchapter does not apply | |
| 21 | 16 | to: | |
| 22 | 17 | (1) vessels with a valid marine document issued by the | |
| 23 | 18 | United States Coast Guard's National Vessel Documentation Center or | |
| 24 | 19 | a federal agency that is a successor to the National Vessel | |
| 25 | 20 | Documentation Center; or | |
| 26 | 21 | (2) an antique outboard motor with a capacity of not | |
| 27 | 22 | more than 25 horsepower. | |
| 28 | 23 | SECTION 3. This Act takes effect September 1, 2021. | |
