10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
11 | 11 | SECTION 1. Chapter 2, Code of Criminal Procedure, is | |
12 | 12 | amended by adding Article 2.33 to read as follows: | |
13 | 13 | Art. 2.33. LAW ENFORCEMENT POLICY PROHIBITING MOTOR VEHICLE | |
14 | 14 | STOP ON SHOULDER OF CERTAIN HIGHWAYS. (a) In this article: | |
15 | 15 | (1) "Controlled access highway" has the meaning | |
16 | 16 | assigned by Section 203.001, Transportation Code. | |
17 | 17 | (2) "Law enforcement agency" means an agency of the | |
18 | 18 | state or an agency of a political subdivision of the state | |
19 | 19 | authorized by law to employ peace officers. | |
20 | 20 | (3) "Motor vehicle stop" has the meaning assigned by | |
21 | 21 | Article 2.132. | |
22 | 22 | (b) Each law enforcement agency in this state shall adopt a | |
23 | 23 | policy prohibiting a peace officer of the agency from making a motor | |
24 | 24 | vehicle stop on the shoulder of a controlled access highway. | |
25 | 25 | SECTION 2. Not later than January 1, 2022, each law | |
26 | 26 | enforcement agency in this state shall adopt the policy required by | |
27 | 27 | Article 2.33, Code of Criminal Procedure, as added by this Act. | |
28 | 28 | SECTION 3. This Act takes effect September 1, 2021. |
