66 AN ACT
77 relating to the weather emergency preparedness of facilities for
88 providing gas or electric service.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter C, Chapter 86, Natural Resources
1111 Code, is amended by adding Section 86.044 to read as follows:
1212 Sec. 86.044. WEATHER EMERGENCY PREPAREDNESS. The
1313 commission by rule shall require an operator of a gas well to
1414 implement measures to prepare the well to operate during a weather
1515 emergency.
1616 SECTION 2. Subchapter A, Chapter 35, Utilities Code, is
1717 amended by adding Section 35.0021 to read as follows:
1818 Sec. 35.0021. WEATHER EMERGENCY PREPAREDNESS. The
1919 commission by rule shall require each provider of generation in the
2020 ERCOT power region to implement measures to prepare generation
2121 facilities to provide adequate electric generation service during a
2222 weather emergency.
2323 SECTION 3. Subchapter D, Chapter 38, Utilities Code, is
2424 amended by adding Section 38.074 to read as follows:
2525 Sec. 38.074. WEATHER EMERGENCY PREPAREDNESS. The
2626 commission by rule shall require each electric cooperative,
2727 municipally owned utility, and transmission and distribution
2828 utility providing transmission or distribution service in the ERCOT
2929 power region to implement measures to prepare facilities to
3030 maintain service quality and reliability during a weather
3131 emergency.
3232 SECTION 4. Section 121.2015(a), Utilities Code, is amended
3333 to read as follows:
3434 (a) The railroad commission shall adopt rules regarding:
3535 (1) public education and awareness relating to gas
3636 pipeline facilities; [and]
3737 (2) community liaison for responding to an emergency
3838 relating to a gas pipeline facility; and
3939 (3) measures gas pipeline facility operators must
4040 implement to prepare gas pipeline facilities to maintain service
4141 quality and reliability during a weather emergency.
4242 SECTION 5. This Act takes effect September 1, 2021.
