6	6	AN ACT
7	7	relating to creating Texas A&M University--Eagle Pass as a
8	8	component institution of The Texas A&M University System.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Chapter 87, Education Code, is amended by adding
11	11	Subchapter M to read as follows:
12	12	SUBCHAPTER M. TEXAS A&M UNIVERSITY--EAGLE PASS
13	13	Sec. 87.881. DEFINITIONS. In this subchapter:
14	14	(1) "Board" means the board of regents of The Texas A&M
15	15	University System.
16	16	(2) "University" means Texas A&M University--Eagle
17	17	Pass.
18	18	Sec. 87.882. ESTABLISHMENT; SCOPE. (a) Texas A&M
19	19	University--Eagle Pass is a general academic teaching institution
20	20	located in Maverick County. The university is a component
21	21	institution of The Texas A&M University System and is under the
22	22	governance, management, and control of the board of regents of The
23	23	Texas A&M University System.
24	24	(b) The board has the same powers and duties concerning
25	25	Texas A&M University--Eagle Pass as are conferred on the board by
26	26	statute concerning Texas A&M University.
27	27	Sec. 87.883. COURSES AND DEGREES. (a) The board may
28	28	prescribe courses leading to customary degrees offered at leading
29	29	American universities and may award those degrees, including
30	30	bachelor's, master's, and doctoral degrees and their equivalents.
31	31	(b) The board shall award degrees in the name of the
32	32	university.
33	33	(c) A department, school, or degree program may not be
34	34	instituted without the prior approval of the Texas Higher Education
35	35	Coordinating Board.
36	36	Sec. 87.884. UNIVERSITY OF THE FIRST CLASS. The board shall
37	37	make any other rules and regulations for the operation, control,
38	38	and management of the university as may be necessary for the conduct
39	39	of the university as a university of the first class.
40	40	Sec. 87.885. FACILITIES. The board shall provide for
41	41	adequate physical facilities for use by the university.
42	42	Sec. 87.886. GIFTS AND GRANTS. The board may solicit,
43	43	accept, and administer, on terms and conditions acceptable to the
44	44	board, gifts, grants, or donations of any kind and from any source
45	45	for use by the university.
46	46	Sec. 87.887. AFFILIATION AGREEMENTS; JOINT APPOINTMENTS.
47	47	(a) The board may execute and carry out with any entity or
48	48	institution affiliation or coordinating agreements that are
49	49	reasonably necessary or desirable for the conduct and operation of
50	50	a university of the first class.
51	51	(b) The board may make joint faculty appointments to
52	52	positions in the university and to positions in other institutions
53	53	under the board's governance. The salary of a person who receives a
54	54	joint appointment shall be apportioned to the appointing
55	55	institutions on the basis of services rendered.
56	56	Sec. 87.888. PARTICIPATION IN PERMANENT UNIVERSITY FUND.
57	57	If the Act enacting this subchapter receives a vote of two-thirds of
58	58	the membership of each house of the legislature, the university is
59	59	entitled to participate in the funding provided by Section 18,
60	60	Article VII, Texas Constitution, to the same extent as similar
61	61	component institutions of The Texas A&M University System.
62	62	SECTION 2. This Act takes effect immediately if it receives
63	63	a vote of two-thirds of all the members elected to each house, as
64	64	provided by Section 39, Article III, Texas Constitution. If this
65	65	Act does not receive the vote necessary for immediate effect, this
66	66	Act takes effect September 1, 2021.
