66 AN ACT
77 relating to creating Texas A&M University--Eagle Pass as a
88 component institution of The Texas A&M University System.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 87, Education Code, is amended by adding
1111 Subchapter M to read as follows:
1212 SUBCHAPTER M. TEXAS A&M UNIVERSITY--EAGLE PASS
1313 Sec. 87.881. DEFINITIONS. In this subchapter:
1414 (1) "Board" means the board of regents of The Texas A&M
1515 University System.
1616 (2) "University" means Texas A&M University--Eagle
1717 Pass.
1818 Sec. 87.882. ESTABLISHMENT; SCOPE. (a) Texas A&M
1919 University--Eagle Pass is a general academic teaching institution
2020 located in Maverick County. The university is a component
2121 institution of The Texas A&M University System and is under the
2222 governance, management, and control of the board of regents of The
2323 Texas A&M University System.
2424 (b) The board has the same powers and duties concerning
2525 Texas A&M University--Eagle Pass as are conferred on the board by
2626 statute concerning Texas A&M University.
2727 Sec. 87.883. COURSES AND DEGREES. (a) The board may
2828 prescribe courses leading to customary degrees offered at leading
2929 American universities and may award those degrees, including
3030 bachelor's, master's, and doctoral degrees and their equivalents.
3131 (b) The board shall award degrees in the name of the
3232 university.
3333 (c) A department, school, or degree program may not be
3434 instituted without the prior approval of the Texas Higher Education
3535 Coordinating Board.
3636 Sec. 87.884. UNIVERSITY OF THE FIRST CLASS. The board shall
3737 make any other rules and regulations for the operation, control,
3838 and management of the university as may be necessary for the conduct
3939 of the university as a university of the first class.
4040 Sec. 87.885. FACILITIES. The board shall provide for
4141 adequate physical facilities for use by the university.
4242 Sec. 87.886. GIFTS AND GRANTS. The board may solicit,
4343 accept, and administer, on terms and conditions acceptable to the
4444 board, gifts, grants, or donations of any kind and from any source
4545 for use by the university.
4646 Sec. 87.887. AFFILIATION AGREEMENTS; JOINT APPOINTMENTS.
4747 (a) The board may execute and carry out with any entity or
4848 institution affiliation or coordinating agreements that are
4949 reasonably necessary or desirable for the conduct and operation of
5050 a university of the first class.
5151 (b) The board may make joint faculty appointments to
5252 positions in the university and to positions in other institutions
5353 under the board's governance. The salary of a person who receives a
5454 joint appointment shall be apportioned to the appointing
5555 institutions on the basis of services rendered.
5656 Sec. 87.888. PARTICIPATION IN PERMANENT UNIVERSITY FUND.
5757 If the Act enacting this subchapter receives a vote of two-thirds of
5858 the membership of each house of the legislature, the university is
5959 entitled to participate in the funding provided by Section 18,
6060 Article VII, Texas Constitution, to the same extent as similar
6161 component institutions of The Texas A&M University System.
6262 SECTION 2. This Act takes effect immediately if it receives
6363 a vote of two-thirds of all the members elected to each house, as
6464 provided by Section 39, Article III, Texas Constitution. If this
6565 Act does not receive the vote necessary for immediate effect, this
6666 Act takes effect September 1, 2021.
