55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to harassment using a temporary or disposable telephone
88 number; creating a criminal offense.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 42.07(a), Penal Code, is amended to read
1111 as follows:
1212 (a) A person commits an offense if, with intent to harass,
1313 annoy, alarm, abuse, torment, or embarrass another, the person:
1414 (1) initiates communication and in the course of the
1515 communication makes a comment, request, suggestion, or proposal
1616 that is obscene;
1717 (2) threatens, in a manner reasonably likely to alarm
1818 the person receiving the threat, to inflict bodily injury on the
1919 person or to commit a felony against the person, a member of the
2020 person's family or household, or the person's property;
2121 (3) conveys, in a manner reasonably likely to alarm
2222 the person receiving the report, a false report, which is known by
2323 the conveyor to be false, that another person has suffered death or
2424 serious bodily injury;
2525 (4) causes the telephone of another to ring repeatedly
2626 or makes repeated telephone communications anonymously or in a
2727 manner reasonably likely to harass, annoy, alarm, abuse, torment,
2828 embarrass, or offend another;
2929 (5) makes a telephone call and intentionally fails to
3030 hang up or disengage the connection;
3131 (6) knowingly permits a telephone under the person's
3232 control to be used by another to commit an offense under this
3333 section; [or]
3434 (7) sends repeated electronic communications in a
3535 manner reasonably likely to harass, annoy, alarm, abuse, torment,
3636 embarrass, or offend another; or
3737 (8) makes obscene, intimidating, or threatening
3838 telephone calls or other electronic communications from a temporary
3939 or disposable telephone number provided by an Internet application
4040 or other technological means.
4141 SECTION 2. The change in law made by this Act applies only
4242 to an offense committed on or after the effective date of this Act.
4343 An offense committed before the effective date of this Act is
4444 governed by the law in effect on the date the offense was committed,
4545 and the former law is continued in effect for that purpose. For
4646 purposes of this section, an offense was committed before the
4747 effective date of this Act if any element of the offense occurred
4848 before that date.
4949 SECTION 3. This Act takes effect September 1, 2021.
