55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the expiration of a protective order when the subject of
88 the protective order is confined or imprisoned.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 85.025, Family Code, is amended by
1111 adding Subsection (d) to read as follows:
1212 (d) As soon as practicable after the release of a person who
1313 is the subject of a protective order from confinement or
1414 imprisonment, the Department of Public Safety shall update the
1515 statewide law enforcement information system maintained by the
1616 department to reflect the date that the order will expire following
1717 the person's release.
1818 SECTION 2. Section 85.026, Family Code, is amended by
1919 adding Subsection (d) to read as follows:
2020 (d) Each protective order issued under this subtitle must
2121 specify when the order expires and must provide notice of any
2222 extensions that may apply to a person who is the subject of the
2323 order, as a result of any confinement or imprisonment of that
2424 person.
2525 SECTION 3. Section 85.025(d), Family Code, as added by this
2626 Act, applies only to a protective order with respect to a person who
2727 is the subject of the order and who is released from confinement or
2828 imprisonment on or after the effective date of this Act.
2929 SECTION 4. Section 85.026(d), Family Code, as added by this
3030 Act, applies only to a protective order issued on or after the
3131 effective date of this Act.
3232 SECTION 5. This Act takes effect September 1, 2021.
