 A BILL TO BE ENTITLED
 AN ACT
 relating to purchases made by a school district and open-enrollment
 charter school using the instructional materials and technology
 allotment.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Section 31.002, Education Code, is amended by
 adding Subsection (5) to read as follows:
 (5)  “Bundle” means one or more instructional materials, as
 defined by this chapter, that are sold together for one price.
 SECTION 2.  Chapter 31, Education Code, is amended by adding
 Section 31.0216 to read as follows:
 Sec. 31.0216.  BUNDLING OF INSTRUCTIONAL MATERIALS.  (a)  A
 school district or open-enrollment charter school entitled to an
 allotment under Section 31.0211 (a), Education Code shall not
 purchase instructional materials or technology from a publisher or
 vendor that bundles instructional materials.
 (b)  It is an exception to the application of this section if
 a school district or open-enrollment charter school deems that the
 bundling of instructional materials or technology from a publisher
 or vendor is beneficial.
 SECTION 3.  This Act takes effect September 1, 2021.
