55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the interconnection of a solar energy device to an
88 electricity distribution system.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter Z, Chapter 39, Utilities Code, is
1111 amended by adding Section 39.9165 to read as follows:
1212 Sec. 39.9165. SOLAR ENERGY DEVICE OWNER RIGHTS. (a) In
1313 this section, "solar energy device" has the meaning assigned by
1414 Section 185.001.
1515 (b) A transmission and distribution utility or electric
1616 utility must allow the owner of a solar energy device that is
1717 interconnected to the utility's electricity distribution system,
1818 at the discretion of the owner, to:
1919 (1) decline to sell electricity produced by the solar
2020 energy device to the distribution system; or
2121 (2) temporarily disconnect from the utility's
2222 electricity distribution system to use on site the electricity
2323 produced by the solar energy device during a power outage or
2424 interruption.
2525 SECTION 2. The changes in law made by this Act apply only to
2626 an original contract entered into on or after the effective date of
2727 this Act. An original contract entered into before the effective
2828 date of this Act is governed by the law as it existed immediately
2929 before the effective date of this Act, and that law is continued in
3030 effect for that purpose.
3131 SECTION 3. This Act takes effect September 1, 2021.
