| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter Z, Chapter 39, Utilities Code, is |
|---|
| 11 | 11 | | amended by adding Section 39.9165 to read as follows: |
|---|
| 12 | 12 | | Sec. 39.9165. SOLAR ENERGY DEVICE OWNER RIGHTS. (a) In |
|---|
| 13 | 13 | | this section, "solar energy device" has the meaning assigned by |
|---|
| 14 | 14 | | Section 185.001. |
|---|
| 15 | 15 | | (b) A transmission and distribution utility or electric |
|---|
| 16 | 16 | | utility must allow the owner of a solar energy device that is |
|---|
| 17 | 17 | | interconnected to the utility's electricity distribution system, |
|---|
| 18 | 18 | | at the discretion of the owner, to: |
|---|
| 19 | 19 | | (1) decline to sell electricity produced by the solar |
|---|
| 20 | 20 | | energy device to the distribution system; or |
|---|
| 21 | 21 | | (2) temporarily disconnect from the utility's |
|---|
| 22 | 22 | | electricity distribution system to use on site the electricity |
|---|
| 23 | 23 | | produced by the solar energy device during a power outage or |
|---|
| 24 | 24 | | interruption. |
|---|
| 25 | 25 | | SECTION 2. The changes in law made by this Act apply only to |
|---|
| 26 | 26 | | an original contract entered into on or after the effective date of |
|---|
| 27 | 27 | | this Act. An original contract entered into before the effective |
|---|
| 28 | 28 | | date of this Act is governed by the law as it existed immediately |
|---|
| 29 | 29 | | before the effective date of this Act, and that law is continued in |
|---|
| 30 | 30 | | effect for that purpose. |
|---|
| 31 | 31 | | SECTION 3. This Act takes effect September 1, 2021. |
