6	6	AN ACT
7	7	relating to the manufacture, delivery, and possession of certain
8	8	tetrahydrocannabinols under the Texas Controlled Substances Act.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Sections 481.002(5) and (6), Health and Safety
11	11	Code, are amended to read as follows:
12	12	(5) "Controlled substance" means a substance,
13	13	including a drug, an adulterant, and a dilutant, listed in
14	14	Schedules I through V or Penalty Group 1, 1-A, 2, 2-A, 2-B, 3, or 4.
15	15	The term includes the aggregate weight of any mixture, solution, or
16	16	other substance containing a controlled substance. The term does
17	17	not include hemp, as defined by Section 121.001, Agriculture Code,
18	18	or the tetrahydrocannabinols in hemp.
19	19	(6) "Controlled substance analogue" means:
20	20	(A) a substance with a chemical structure
21	21	substantially similar to the chemical structure of a controlled
22	22	substance in Schedule I or II or Penalty Group 1, 1-A, 2, [or] 2-A,
23	23	or 2-B; or
24	24	(B) a substance specifically designed to produce
25	25	an effect substantially similar to, or greater than, the effect of a
26	26	controlled substance in Schedule I or II or Penalty Group 1, 1-A, 2,
27	27	[or] 2-A, or 2-B.
28	28	SECTION 2. Section 481.103(a), Health and Safety Code, is
29	29	amended to read as follows:
30	30	(a) Penalty Group 2 consists of:
31	31	(1) any quantity of the following hallucinogenic
32	32	substances, their salts, isomers, and salts of isomers, unless
33	33	specifically excepted, if the existence of these salts, isomers,
34	34	and salts of isomers is possible within the specific chemical
35	35	designation:
36	36	5-(2-aminopropyl)benzofuran (5-APB);
37	37	6-(2-aminopropyl)benzofuran (6-APB);
38	38	5-(2-aminopropyl)-2,3-dihydrobenzofuran
39	39	(5-APDB);
40	40	6-(2-aminopropyl)-2,3-dihydrobenzofuran
41	41	(6-APDB);
42	42	5-(2-aminopropyl)indole (5-IT,5-API);

211	211	with an alkyl or alkenyl group;
212	212	(iii) by substitution in the 6-membered
213	213	ring to any extent with alkyl, alkoxy, haloalkyl, thioaklyl,
214	214	alkylenedioxy, or halide substituents; or
215	215	(iv) by substitution at the 2-position of
216	216	the tryptamine ring system with an alkyl substituent; and
217	217	(B) including:

287	287	SECTION 3. Subchapter D, Chapter 481, Health and Safety
288	288	Code, is amended by adding Section 481.1032 to read as follows:
289	289	Sec. 481.1032. PENALTY GROUP 2-B. (a) Penalty Group 2-B
290	290	consists of any quantity of the following substances, their salts,
291	291	isomers, and salts of isomers, unless specifically excepted, if the
292	292	existence of these salts, isomers, and salts of isomers is possible
293	293	within the specific chemical designation:
294	294	Tetrahydrocannabinols, other than marihuana, and
295	295	synthetic equivalents of the substances contained in the plant, or
296	296	in the resinous extractives of Cannabis, or synthetic substances,
297	297	derivatives, and their isomers with similar chemical structure and
298	298	pharmacological activity such as:
299	299	delta-1 cis or trans tetrahydrocannabinol, and
300	300	their optical isomers;
301	301	delta-6 cis or trans tetrahydrocannabinol, and
302	302	their optical isomers;
303	303	delta-3, 4 cis or trans tetrahydrocannabinol, and
304	304	its optical isomers; or
305	305	compounds of these structures, regardless of
306	306	numerical designation of atomic positions, since nomenclature of
307	307	these substances is not internationally standardized.
308	308	(b) For the purposes of this section, the term "isomer"
309	309	includes an optical, position, or geometric isomer.
310	310	SECTION 4. Section 481.106, Health and Safety Code, is
311	311	amended to read as follows:
312	312	Sec. 481.106. CLASSIFICATION OF CONTROLLED SUBSTANCE
313	313	ANALOGUE. For the purposes of the prosecution of an offense under
314	314	this subchapter involving the manufacture, delivery, or possession
315	315	of a controlled substance, Penalty Groups 1, 1-A, 2, [and] 2-A, and
316	316	2-B include a controlled substance analogue that:
317	317	(1) has a chemical structure substantially similar to
318	318	the chemical structure of a controlled substance listed in the
319	319	applicable penalty group; or
320	320	(2) is specifically designed to produce an effect
321	321	substantially similar to, or greater than, a controlled substance
322	322	listed in the applicable penalty group.
323	323	SECTION 5. Section 481.111(c), Health and Safety Code, is
324	324	amended to read as follows:
325	325	(c) A person does not violate Section 481.113, 481.1132,
326	326	481.116, 481.1161, 481.1162, 481.121, or 481.125 if the person
327	327	possesses or delivers tetrahydrocannabinols or their derivatives,
328	328	or drug paraphernalia to be used to introduce tetrahydrocannabinols
329	329	or their derivatives into the human body, for use in a federally
330	330	approved therapeutic research program.
331	331	SECTION 6. Subchapter D, Chapter 481, Health and Safety
332	332	Code, is amended by adding Section 481.1132 to read as follows:
333	333	Sec. 481.1132. OFFENSE: MANUFACTURE OR DELIVERY OF
334	334	SUBSTANCE IN PENALTY GROUP 2-B. (a) Except as authorized by this
335	335	chapter, a person commits an offense if the person knowingly
336	336	manufactures, delivers, or possesses with intent to deliver a
337	337	controlled substance listed in Penalty Group 2-B.
338	338	(b) An offense under Subsection (a) is a Class A misdemeanor
339	339	if the amount of the controlled substance to which the offense
340	340	applies is, by aggregate weight, including adulterants or
341	341	dilutants, less than 50 grams.
342	342	(c) An offense under Subsection (a) is a state jail felony
343	343	of the second degree if the amount of the controlled substance to
344	344	which the offense applies is, by aggregate weight, including
345	345	adulterants or dilutants, 50 grams or more but less than 100 grams.
346	346	(d) An offense under Subsection (a) is a felony of the third
347	347	degree if the amount of the controlled substance to which the
348	348	offense applies is, by aggregate weight, including adulterants or
349	349	dilutants, 100 grams or more.
350	350	SECTION 7. Subchapter D, Chapter 481, Health and Safety
351	351	Code, is amended by adding Section 481.1162 to read as follows:
352	352	Sec. 481.1162. POSSESSION OF SUBSTANCE IN PENALTY GROUP
353	353	2-B. (a) Except as authorized by this chapter, a person commits an
354	354	offense if the person knowingly possesses a controlled substance
355	355	listed in Penalty Group 2-B, unless the person obtained the
356	356	substance directly from or under a valid prescription or order of a
357	357	practitioner acting in the course of professional practice.
358	358	(b) An offense under this section is:
359	359	(1) a Class B misdemeanor if the amount of the
360	360	controlled substance possessed is, by aggregate weight, including
361	361	adulterants or dilutants, 50 grams or less;
362	362	(2) a Class A misdemeanor if the amount of the
363	363	controlled substance possessed is, by aggregate weight, including
364	364	adulterants or dilutants, 100 grams or less but more than 50 grams;
365	365	and
366	366	(3) a state jail felony if the amount of the controlled
367	367	substance possessed is, by aggregate weight, including adulterants
368	368	or dilutants, more than 100 grams.
369	369	SECTION 8. Section 481.122(a), Health and Safety Code, is
370	370	amended to read as follows:
371	371	(a) A person commits an offense if the person knowingly
372	372	delivers a controlled substance listed in Penalty Group 1, 1-A, 2,
373	373	2-A, 2-B, or 3 or knowingly delivers marihuana and the person
374	374	delivers the controlled substance or marihuana to a person:
375	375	(1) who is a child;
376	376	(2) who is enrolled in a public or private primary or
377	377	secondary school; or
378	378	(3) who the actor knows or believes intends to deliver
379	379	the controlled substance or marihuana to a person described by
380	380	Subdivision (1) or (2).
381	381	SECTION 9. Sections 481.134(b), (c), (d), (e), and (f),
382	382	Health and Safety Code, are amended to read as follows:
383	383	(b) An offense otherwise punishable as a state jail felony
384	384	under Section 481.112, 481.1121, 481.113, 481.1132, 481.114, or
385	385	481.120 is punishable as a felony of the third degree, an offense
386	386	otherwise punishable as a felony of the third degree is punishable
387	387	as a felony of the second degree, and an offense otherwise
388	388	punishable as a felony of the second degree under any of those
389	389	sections is punishable as a felony of the first degree, if it is
390	390	shown at the punishment phase of the trial of the offense that the
391	391	offense was committed:
392	392	(1) in, on, or within 1,000 feet of premises owned,
393	393	rented, or leased by an institution of higher education [learning],
394	394	the premises of a public or private youth center, or a playground;
395	395	or
396	396	(2) in, on, or within 300 feet of the premises of a
397	397	public swimming pool or video arcade facility.
398	398	(c) The minimum term of confinement or imprisonment for an
399	399	offense otherwise punishable under Section 481.112(c), (d), (e), or
400	400	(f), 481.1121(b)(2), (3), or (4), 481.113(c), (d), or (e),
401	401	481.1132(d), 481.114(c), (d), or (e), 481.115(c), (d), (e), or (f)
402	402	[481.115(c)-(f)], 481.1151(b)(2), (3), (4), or (5), 481.116(c),
403	403	(d), or (e), 481.1161(b)(4), (5), or (6), 481.117(c), (d), or (e),
404	404	481.118(c), (d), or (e), 481.120(b)(4), (5), or (6), or
405	405	481.121(b)(4), (5), or (6) is increased by five years and the
406	406	maximum fine for the offense is doubled if it is shown on the trial
407	407	of the offense that the offense was committed:
408	408	(1) in, on, or within 1,000 feet of the premises of a
409	409	school, the premises of a public or private youth center, or a
410	410	playground; or
411	411	(2) on a school bus.
412	412	(d) An offense otherwise punishable under Section
413	413	481.112(b), 481.1121(b)(1), 481.113(b), 481.1132(c), 481.114(b),
414	414	481.115(b), 481.1151(b)(1), 481.116(b), 481.1161(b)(3),
415	415	481.1162(b)(3), 481.120(b)(3), or 481.121(b)(3) is a felony of the
416	416	third degree if it is shown on the trial of the offense that the
417	417	offense was committed:

420	420	premises of a public or private youth center, or a playground; or
421	421	(2) on a school bus.
422	422	(e) An offense otherwise punishable under Section
423	423	481.1132(b), 481.1162(b)(2), 481.117(b), 481.119(a),
424	424	481.120(b)(2), or 481.121(b)(2) is a state jail felony if it is
425	425	shown on the trial of the offense that the offense was committed:
426	426	(1) in, on, or within 1,000 feet of any real property
427	427	that is owned, rented, or leased to a school or school board, the
428	428	premises of a public or private youth center, or a playground; or
429	429	(2) on a school bus.
430	430	(f) An offense otherwise punishable under Section
431	431	481.1162(b)(1), 481.118(b), 481.119(b), 481.120(b)(1), or
432	432	481.121(b)(1) is a Class A misdemeanor if it is shown on the trial
433	433	of the offense that the offense was committed:
434	434	(1) in, on, or within 1,000 feet of any real property
435	435	that is owned, rented, or leased to a school or school board, the
436	436	premises of a public or private youth center, or a playground; or
437	437	(2) on a school bus.
438	438	SECTION 10. Section 481.140(a), Health and Safety Code, is
439	439	amended to read as follows:
440	440	(a) If it is shown at the punishment phase of the trial of an
441	441	offense otherwise punishable as a state jail felony, felony of the
442	442	third degree, or felony of the second degree under Section 481.112,
443	443	481.1121, 481.113, 481.1132, 481.114, 481.120, or 481.122 that the
444	444	defendant used or attempted to use a child younger than 18 years of
445	445	age to commit or assist in the commission of the offense, the
446	446	punishment is increased by one degree, unless the defendant used or
447	447	threatened to use force against the child or another to gain the
448	448	child's assistance, in which event the punishment for the offense
449	449	is a felony of the first degree.
450	450	SECTION 11. Section 481.141(b), Health and Safety Code, is
451	451	amended to read as follows:
452	452	(b) This section applies to an offense otherwise punishable
453	453	as a state jail felony, felony of the third degree, or felony of the
454	454	second degree under Section 481.112, 481.1121, 481.113, 481.1132,
455	455	481.114, or 481.122.
456	456	SECTION 12. Article 14.06(d), Code of Criminal Procedure,
457	457	is amended to read as follows:
458	458	(d) Subsection (c) applies only to a person charged with
459	459	committing an offense under:
460	460	(1) Section 481.121, Health and Safety Code, if the
461	461	offense is punishable under Subsection (b)(1) or (2) of that
462	462	section;
463	463	(1-a) Section 481.1161, Health and Safety Code, if the
464	464	offense is punishable under Subsection (b)(1) or (2) of that
465	465	section;
466	466	(1-b) Section 481.1162, Health and Safety Code, if the
467	467	offense is punishable under Subsection (b)(1) or (2) of that
468	468	section;
469	469	(2) Section 28.03, Penal Code, if the offense is
470	470	punishable under Subsection (b)(2) of that section;
471	471	(3) Section 28.08, Penal Code, if the offense is
472	472	punishable under Subsection (b)(2) or (3) of that section;
473	473	(4) Section 31.03, Penal Code, if the offense is
474	474	punishable under Subsection (e)(2)(A) of that section;
475	475	(5) Section 31.04, Penal Code, if the offense is
476	476	punishable under Subsection (e)(2) of that section;
477	477	(6) Section 38.114, Penal Code, if the offense is
478	478	punishable as a Class B misdemeanor; or
479	479	(7) Section 521.457, Transportation Code.
480	480	SECTION 13. Article 42A.514(a), Code of Criminal Procedure,
481	481	is amended to read as follows:
482	482	(a) If a judge grants community supervision to a defendant
483	483	younger than 18 years of age convicted of an alcohol-related
484	484	offense under Section 106.02, 106.025, 106.04, 106.041, 106.05, or
485	485	106.07, Alcoholic Beverage Code, or Section 49.02, Penal Code, or
486	486	an offense involving possession of a controlled substance or
487	487	marihuana under Section 481.115, 481.1151, 481.116, 481.1161,
488	488	481.1162, 481.117, 481.118, or 481.121, Health and Safety Code, the
489	489	judge may require the defendant as a condition of community
490	490	supervision to attend, as appropriate:
491	491	(1) an alcohol awareness program approved under
492	492	Section 106.115, Alcoholic Beverage Code; or
493	493	(2) a drug education program that is designed to
494	494	educate persons on the dangers of drug abuse and is approved by the
495	495	Department of State Health Services in accordance with Section
496	496	521.374, Transportation Code.
497	497	SECTION 14. Article 42A.551(a), Code of Criminal Procedure,
498	498	is amended to read as follows:
499	499	(a) Except as otherwise provided by Subsection (b) or (c),
500	500	on conviction of a state jail felony under Section 481.115(b),
501	501	481.1151(b)(1), 481.116(b), 481.1161(b)(3), 481.1162(b)(3),
502	502	481.121(b)(3), or 481.129(g)(1), Health and Safety Code, that is
503	503	punished under Section 12.35(a), Penal Code, the judge shall
504	504	suspend the imposition of the sentence and place the defendant on
505	505	community supervision.
506	506	SECTION 15. Article 42A.555(a), Code of Criminal Procedure,
507	507	is amended to read as follows:
508	508	(a) A judge assessing punishment in a state jail felony case
509	509	may impose as a condition of community supervision that a defendant
510	510	submit at the beginning of the period of community supervision to a
511	511	term of confinement in a state jail felony facility for a term of:
512	512	(1) not less than 90 days or more than 180 days; or
513	513	(2) not less than 90 days or more than one year, if the
514	514	defendant is convicted of an offense punishable as a state jail
515	515	felony under Section 481.112, 481.1121, 481.113, 481.1132, or
516	516	481.120, Health and Safety Code.
517	517	SECTION 16. Section 53.03(h-1), Family Code, is amended to
518	518	read as follows:
519	519	(h-1) If the child is alleged to have engaged in delinquent
520	520	conduct or conduct indicating a need for supervision that violates
521	521	Section 481.115, 481.1151, 481.116, 481.1161, 481.1162, 481.117,
522	522	481.118, or 481.121, Health and Safety Code, deferred prosecution
523	523	under this section may include a condition that the child attend a
524	524	drug education program that is designed to educate persons on the
525	525	dangers of drug abuse and is approved by the Department of State
526	526	Health Services in accordance with Section 521.374, Transportation
527	527	Code.
528	528	SECTION 17. Section 54.047(a), Family Code, is amended to
529	529	read as follows:
530	530	(a) If the court or jury finds at an adjudication hearing
531	531	for a child that the child engaged in delinquent conduct or conduct
532	532	indicating a need for supervision that constitutes a violation of
533	533	Section 481.115, 481.1151, 481.116, 481.1161, 481.1162, 481.117,
534	534	481.118, or 481.121, Health and Safety Code, the court may order
535	535	that the child attend a drug education program that is designed to
536	536	educate persons on the dangers of drug abuse and is approved by the
537	537	Department of State Health Services in accordance with Section
538	538	521.374, Transportation Code.
539	539	SECTION 18. Sections 551.003(11) and (12), Occupations
540	540	Code, are amended to read as follows:
541	541	(11) "Controlled substance" means a substance,
542	542	including a drug:
543	543	(A) listed in Schedule I, II, III, IV, or V, as
544	544	established by the commissioner of public health under Chapter 481,
545	545	Health and Safety Code, or in Penalty Group 1, 1-A, 2, 2-A, 2-B, 3,
546	546	or 4, Chapter 481; or
547	547	(B) included in Schedule I, II, III, IV, or V of
548	548	the Comprehensive Drug Abuse Prevention and Control Act of 1970 (21
549	549	U.S.C. Section 801 et seq.).
550	550	(12) "Dangerous drug" means a drug or device that:
551	551	(A) is not included in Penalty Group 1, 1-A, 2,
552	552	2-A, 2-B, 3, or 4, Chapter 481, Health and Safety Code, and is
553	553	unsafe for self-medication; or
554	554	(B) bears or is required to bear the legend:
555	555	(i) "Caution: federal law prohibits
556	556	dispensing without prescription" or "Rx only" or another legend
557	557	that complies with federal law; or
558	558	(ii) "Caution: federal law restricts this
559	559	drug to use by or on the order of a licensed veterinarian."
560	560	SECTION 19. The change in law made by this Act applies only
561	561	to an offense committed on or after the effective date of this Act.
562	562	An offense committed before the effective date of this Act is
563	563	governed by the law in effect when the offense was committed, and
564	564	the former law is continued in effect for that purpose. For purposes
565	565	of this section, an offense was committed before the effective date
566	566	of this Act if any element of the offense occurred before that date.
567	567	SECTION 20. This Act takes effect September 1, 2021.
