66 AN ACT
77 relating to the manufacture, delivery, and possession of certain
88 tetrahydrocannabinols under the Texas Controlled Substances Act.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 481.002(5) and (6), Health and Safety
1111 Code, are amended to read as follows:
1212 (5) "Controlled substance" means a substance,
1313 including a drug, an adulterant, and a dilutant, listed in
1414 Schedules I through V or Penalty Group 1, 1-A, 2, 2-A, 2-B, 3, or 4.
1515 The term includes the aggregate weight of any mixture, solution, or
1616 other substance containing a controlled substance. The term does
1717 not include hemp, as defined by Section 121.001, Agriculture Code,
1818 or the tetrahydrocannabinols in hemp.
1919 (6) "Controlled substance analogue" means:
2020 (A) a substance with a chemical structure
2121 substantially similar to the chemical structure of a controlled
2222 substance in Schedule I or II or Penalty Group 1, 1-A, 2, [or] 2-A,
2323 or 2-B; or
2424 (B) a substance specifically designed to produce
2525 an effect substantially similar to, or greater than, the effect of a
2626 controlled substance in Schedule I or II or Penalty Group 1, 1-A, 2,
2727 [or] 2-A, or 2-B.
2828 SECTION 2. Section 481.103(a), Health and Safety Code, is
2929 amended to read as follows:
3030 (a) Penalty Group 2 consists of:
3131 (1) any quantity of the following hallucinogenic
3232 substances, their salts, isomers, and salts of isomers, unless
3333 specifically excepted, if the existence of these salts, isomers,
3434 and salts of isomers is possible within the specific chemical
3535 designation:
3636 5-(2-aminopropyl)benzofuran (5-APB);
3737 6-(2-aminopropyl)benzofuran (6-APB);
3838 5-(2-aminopropyl)-2,3-dihydrobenzofuran
3939 (5-APDB);

170170 ring system by other substituents;
171171 (ii) substitution at the 3-position with an
172172 alkyl substituent; or
173173 (iii) substitution at the 2-amino nitrogen
174174 atom with alkyl, benzyl, dialkyl, or methoxybenzyl groups, or
175175 inclusion of the 2-amino nitrogen atom in a cyclic structure; and

208208 other atoms of the side chain) in a cyclic structure;
209209 (ii) by substitution at the carbon atom
210210 adjacent to the nitrogen atom of the side chain (alpha-position)
211211 with an alkyl or alkenyl group;
212212 (iii) by substitution in the 6-membered
213213 ring to any extent with alkyl, alkoxy, haloalkyl, thioaklyl,
214214 alkylenedioxy, or halide substituents; or
215215 (iv) by substitution at the 2-position of
216216 the tryptamine ring system with an alkyl substituent; and
217217 (B) including:
218218 (i) ethers and esters of the controlled
219219 substances listed in this subdivision; and
220220 (ii) by example, compounds such as:
221221 alpha-ethyltryptamine;
222222 alpha-methyltryptamine;
223223 Bufotenine (some trade and other names:
224224 3-(beta-Dimethylaminoethyl)-5-hydroxyindole;
225225 3-(2-dimethylaminoethyl)- 5- indolol; N, N-dimethylserotonin;
226226 5-hydroxy-N, N- dimethyltryptamine; mappine);
227227 Diethyltryptamine (some trade and
228228 other names: N, N-Diethyltryptamine, DET);
229229 Dimethyltryptamine (trade or other
230230 name: DMT);
231231 5-methoxy-N, N-diisopropyltryptamine
232232 (5-MeO-DiPT);
233233 O-Acetylpsilocin (Trade or other name:
234234 4-Aco-DMT);

243243 other name: 2C-B);
244244 4-Chloro-2,5-dimethoxyphenethylamine (trade or
245245 other name: 2C-C);
246246 2,5-Dimethoxy-4-methylphenethylamine (trade or
247247 other name: 2C-D);
248248 4-Ethyl-2,5-dimethoxyphenethylamine (trade or

272272 name: DOB);
273273 4-Chloro-2,5-dimethoxyamphetamine (trade or

287287 SECTION 3. Subchapter D, Chapter 481, Health and Safety
288288 Code, is amended by adding Section 481.1032 to read as follows:
289289 Sec. 481.1032. PENALTY GROUP 2-B. (a) Penalty Group 2-B
290290 consists of any quantity of the following substances, their salts,
291291 isomers, and salts of isomers, unless specifically excepted, if the
292292 existence of these salts, isomers, and salts of isomers is possible
293293 within the specific chemical designation:
294294 Tetrahydrocannabinols, other than marihuana, and
295295 synthetic equivalents of the substances contained in the plant, or
296296 in the resinous extractives of Cannabis, or synthetic substances,
297297 derivatives, and their isomers with similar chemical structure and
298298 pharmacological activity such as:
299299 delta-1 cis or trans tetrahydrocannabinol, and
300300 their optical isomers;
301301 delta-6 cis or trans tetrahydrocannabinol, and
302302 their optical isomers;
303303 delta-3, 4 cis or trans tetrahydrocannabinol, and
304304 its optical isomers; or
305305 compounds of these structures, regardless of
306306 numerical designation of atomic positions, since nomenclature of
307307 these substances is not internationally standardized.
308308 (b) For the purposes of this section, the term "isomer"
309309 includes an optical, position, or geometric isomer.
310310 SECTION 4. Section 481.106, Health and Safety Code, is
311311 amended to read as follows:
312312 Sec. 481.106. CLASSIFICATION OF CONTROLLED SUBSTANCE
313313 ANALOGUE. For the purposes of the prosecution of an offense under
314314 this subchapter involving the manufacture, delivery, or possession
315315 of a controlled substance, Penalty Groups 1, 1-A, 2, [and] 2-A, and
316316 2-B include a controlled substance analogue that:
317317 (1) has a chemical structure substantially similar to
318318 the chemical structure of a controlled substance listed in the
319319 applicable penalty group; or
320320 (2) is specifically designed to produce an effect
321321 substantially similar to, or greater than, a controlled substance
322322 listed in the applicable penalty group.
323323 SECTION 5. Section 481.111(c), Health and Safety Code, is
324324 amended to read as follows:
325325 (c) A person does not violate Section 481.113, 481.1132,
326326 481.116, 481.1161, 481.1162, 481.121, or 481.125 if the person
327327 possesses or delivers tetrahydrocannabinols or their derivatives,
328328 or drug paraphernalia to be used to introduce tetrahydrocannabinols
329329 or their derivatives into the human body, for use in a federally
330330 approved therapeutic research program.
331331 SECTION 6. Subchapter D, Chapter 481, Health and Safety
332332 Code, is amended by adding Section 481.1132 to read as follows:
333333 Sec. 481.1132. OFFENSE: MANUFACTURE OR DELIVERY OF
334334 SUBSTANCE IN PENALTY GROUP 2-B. (a) Except as authorized by this
335335 chapter, a person commits an offense if the person knowingly
336336 manufactures, delivers, or possesses with intent to deliver a
337337 controlled substance listed in Penalty Group 2-B.
338338 (b) An offense under Subsection (a) is a Class A misdemeanor
339339 if the amount of the controlled substance to which the offense
340340 applies is, by aggregate weight, including adulterants or
341341 dilutants, less than 50 grams.
342342 (c) An offense under Subsection (a) is a state jail felony
343343 of the second degree if the amount of the controlled substance to
344344 which the offense applies is, by aggregate weight, including
345345 adulterants or dilutants, 50 grams or more but less than 100 grams.
346346 (d) An offense under Subsection (a) is a felony of the third
347347 degree if the amount of the controlled substance to which the
348348 offense applies is, by aggregate weight, including adulterants or
349349 dilutants, 100 grams or more.
350350 SECTION 7. Subchapter D, Chapter 481, Health and Safety
351351 Code, is amended by adding Section 481.1162 to read as follows:
352352 Sec. 481.1162. POSSESSION OF SUBSTANCE IN PENALTY GROUP
353353 2-B. (a) Except as authorized by this chapter, a person commits an
354354 offense if the person knowingly possesses a controlled substance
355355 listed in Penalty Group 2-B, unless the person obtained the
356356 substance directly from or under a valid prescription or order of a
357357 practitioner acting in the course of professional practice.
358358 (b) An offense under this section is:
359359 (1) a Class B misdemeanor if the amount of the
360360 controlled substance possessed is, by aggregate weight, including
361361 adulterants or dilutants, 50 grams or less;
362362 (2) a Class A misdemeanor if the amount of the
363363 controlled substance possessed is, by aggregate weight, including
364364 adulterants or dilutants, 100 grams or less but more than 50 grams;
365365 and
366366 (3) a state jail felony if the amount of the controlled
367367 substance possessed is, by aggregate weight, including adulterants
368368 or dilutants, more than 100 grams.
369369 SECTION 8. Section 481.122(a), Health and Safety Code, is
370370 amended to read as follows:
371371 (a) A person commits an offense if the person knowingly
372372 delivers a controlled substance listed in Penalty Group 1, 1-A, 2,
373373 2-A, 2-B, or 3 or knowingly delivers marihuana and the person
374374 delivers the controlled substance or marihuana to a person:
375375 (1) who is a child;
376376 (2) who is enrolled in a public or private primary or
377377 secondary school; or
378378 (3) who the actor knows or believes intends to deliver
379379 the controlled substance or marihuana to a person described by
380380 Subdivision (1) or (2).
381381 SECTION 9. Sections 481.134(b), (c), (d), (e), and (f),
382382 Health and Safety Code, are amended to read as follows:
383383 (b) An offense otherwise punishable as a state jail felony
384384 under Section 481.112, 481.1121, 481.113, 481.1132, 481.114, or
385385 481.120 is punishable as a felony of the third degree, an offense
386386 otherwise punishable as a felony of the third degree is punishable
387387 as a felony of the second degree, and an offense otherwise
388388 punishable as a felony of the second degree under any of those
389389 sections is punishable as a felony of the first degree, if it is
390390 shown at the punishment phase of the trial of the offense that the
391391 offense was committed:
392392 (1) in, on, or within 1,000 feet of premises owned,
393393 rented, or leased by an institution of higher education [learning],
394394 the premises of a public or private youth center, or a playground;
395395 or
396396 (2) in, on, or within 300 feet of the premises of a
397397 public swimming pool or video arcade facility.
398398 (c) The minimum term of confinement or imprisonment for an
399399 offense otherwise punishable under Section 481.112(c), (d), (e), or
400400 (f), 481.1121(b)(2), (3), or (4), 481.113(c), (d), or (e),
401401 481.1132(d), 481.114(c), (d), or (e), 481.115(c), (d), (e), or (f)
402402 [481.115(c)-(f)], 481.1151(b)(2), (3), (4), or (5), 481.116(c),
403403 (d), or (e), 481.1161(b)(4), (5), or (6), 481.117(c), (d), or (e),
404404 481.118(c), (d), or (e), 481.120(b)(4), (5), or (6), or
405405 481.121(b)(4), (5), or (6) is increased by five years and the
406406 maximum fine for the offense is doubled if it is shown on the trial
407407 of the offense that the offense was committed:
408408 (1) in, on, or within 1,000 feet of the premises of a
409409 school, the premises of a public or private youth center, or a
410410 playground; or
411411 (2) on a school bus.
412412 (d) An offense otherwise punishable under Section
413413 481.112(b), 481.1121(b)(1), 481.113(b), 481.1132(c), 481.114(b),
414414 481.115(b), 481.1151(b)(1), 481.116(b), 481.1161(b)(3),
415415 481.1162(b)(3), 481.120(b)(3), or 481.121(b)(3) is a felony of the
416416 third degree if it is shown on the trial of the offense that the
417417 offense was committed:
418418 (1) in, on, or within 1,000 feet of any real property
419419 that is owned, rented, or leased to a school or school board, the
420420 premises of a public or private youth center, or a playground; or
421421 (2) on a school bus.
422422 (e) An offense otherwise punishable under Section
423423 481.1132(b), 481.1162(b)(2), 481.117(b), 481.119(a),
424424 481.120(b)(2), or 481.121(b)(2) is a state jail felony if it is
425425 shown on the trial of the offense that the offense was committed:
426426 (1) in, on, or within 1,000 feet of any real property
427427 that is owned, rented, or leased to a school or school board, the
428428 premises of a public or private youth center, or a playground; or
429429 (2) on a school bus.
430430 (f) An offense otherwise punishable under Section
431431 481.1162(b)(1), 481.118(b), 481.119(b), 481.120(b)(1), or
432432 481.121(b)(1) is a Class A misdemeanor if it is shown on the trial
433433 of the offense that the offense was committed:
434434 (1) in, on, or within 1,000 feet of any real property
435435 that is owned, rented, or leased to a school or school board, the
436436 premises of a public or private youth center, or a playground; or
437437 (2) on a school bus.
438438 SECTION 10. Section 481.140(a), Health and Safety Code, is
439439 amended to read as follows:
440440 (a) If it is shown at the punishment phase of the trial of an
441441 offense otherwise punishable as a state jail felony, felony of the
442442 third degree, or felony of the second degree under Section 481.112,
443443 481.1121, 481.113, 481.1132, 481.114, 481.120, or 481.122 that the
444444 defendant used or attempted to use a child younger than 18 years of
445445 age to commit or assist in the commission of the offense, the
446446 punishment is increased by one degree, unless the defendant used or
447447 threatened to use force against the child or another to gain the
448448 child's assistance, in which event the punishment for the offense
449449 is a felony of the first degree.
450450 SECTION 11. Section 481.141(b), Health and Safety Code, is
451451 amended to read as follows:
452452 (b) This section applies to an offense otherwise punishable
453453 as a state jail felony, felony of the third degree, or felony of the
454454 second degree under Section 481.112, 481.1121, 481.113, 481.1132,
455455 481.114, or 481.122.
456456 SECTION 12. Article 14.06(d), Code of Criminal Procedure,
457457 is amended to read as follows:
458458 (d) Subsection (c) applies only to a person charged with
459459 committing an offense under:
460460 (1) Section 481.121, Health and Safety Code, if the
461461 offense is punishable under Subsection (b)(1) or (2) of that
462462 section;
463463 (1-a) Section 481.1161, Health and Safety Code, if the
464464 offense is punishable under Subsection (b)(1) or (2) of that
465465 section;
466466 (1-b) Section 481.1162, Health and Safety Code, if the
467467 offense is punishable under Subsection (b)(1) or (2) of that
468468 section;
469469 (2) Section 28.03, Penal Code, if the offense is
470470 punishable under Subsection (b)(2) of that section;
471471 (3) Section 28.08, Penal Code, if the offense is
472472 punishable under Subsection (b)(2) or (3) of that section;
473473 (4) Section 31.03, Penal Code, if the offense is
474474 punishable under Subsection (e)(2)(A) of that section;
475475 (5) Section 31.04, Penal Code, if the offense is
476476 punishable under Subsection (e)(2) of that section;
477477 (6) Section 38.114, Penal Code, if the offense is
478478 punishable as a Class B misdemeanor; or
479479 (7) Section 521.457, Transportation Code.
480480 SECTION 13. Article 42A.514(a), Code of Criminal Procedure,
481481 is amended to read as follows:
482482 (a) If a judge grants community supervision to a defendant
483483 younger than 18 years of age convicted of an alcohol-related
484484 offense under Section 106.02, 106.025, 106.04, 106.041, 106.05, or
485485 106.07, Alcoholic Beverage Code, or Section 49.02, Penal Code, or
486486 an offense involving possession of a controlled substance or
487487 marihuana under Section 481.115, 481.1151, 481.116, 481.1161,
488488 481.1162, 481.117, 481.118, or 481.121, Health and Safety Code, the
489489 judge may require the defendant as a condition of community
490490 supervision to attend, as appropriate:
491491 (1) an alcohol awareness program approved under
492492 Section 106.115, Alcoholic Beverage Code; or
493493 (2) a drug education program that is designed to
494494 educate persons on the dangers of drug abuse and is approved by the
495495 Department of State Health Services in accordance with Section
496496 521.374, Transportation Code.
497497 SECTION 14. Article 42A.551(a), Code of Criminal Procedure,
498498 is amended to read as follows:
499499 (a) Except as otherwise provided by Subsection (b) or (c),
500500 on conviction of a state jail felony under Section 481.115(b),
501501 481.1151(b)(1), 481.116(b), 481.1161(b)(3), 481.1162(b)(3),
502502 481.121(b)(3), or 481.129(g)(1), Health and Safety Code, that is
503503 punished under Section 12.35(a), Penal Code, the judge shall
504504 suspend the imposition of the sentence and place the defendant on
505505 community supervision.
506506 SECTION 15. Article 42A.555(a), Code of Criminal Procedure,
507507 is amended to read as follows:
508508 (a) A judge assessing punishment in a state jail felony case
509509 may impose as a condition of community supervision that a defendant
510510 submit at the beginning of the period of community supervision to a
511511 term of confinement in a state jail felony facility for a term of:
512512 (1) not less than 90 days or more than 180 days; or
513513 (2) not less than 90 days or more than one year, if the
514514 defendant is convicted of an offense punishable as a state jail
515515 felony under Section 481.112, 481.1121, 481.113, 481.1132, or
516516 481.120, Health and Safety Code.
517517 SECTION 16. Section 53.03(h-1), Family Code, is amended to
518518 read as follows:
519519 (h-1) If the child is alleged to have engaged in delinquent
520520 conduct or conduct indicating a need for supervision that violates
521521 Section 481.115, 481.1151, 481.116, 481.1161, 481.1162, 481.117,
522522 481.118, or 481.121, Health and Safety Code, deferred prosecution
523523 under this section may include a condition that the child attend a
524524 drug education program that is designed to educate persons on the
525525 dangers of drug abuse and is approved by the Department of State
526526 Health Services in accordance with Section 521.374, Transportation
527527 Code.
528528 SECTION 17. Section 54.047(a), Family Code, is amended to
529529 read as follows:
530530 (a) If the court or jury finds at an adjudication hearing
531531 for a child that the child engaged in delinquent conduct or conduct
532532 indicating a need for supervision that constitutes a violation of
533533 Section 481.115, 481.1151, 481.116, 481.1161, 481.1162, 481.117,
534534 481.118, or 481.121, Health and Safety Code, the court may order
535535 that the child attend a drug education program that is designed to
536536 educate persons on the dangers of drug abuse and is approved by the
537537 Department of State Health Services in accordance with Section
538538 521.374, Transportation Code.
539539 SECTION 18. Sections 551.003(11) and (12), Occupations
540540 Code, are amended to read as follows:
541541 (11) "Controlled substance" means a substance,
542542 including a drug:
543543 (A) listed in Schedule I, II, III, IV, or V, as
544544 established by the commissioner of public health under Chapter 481,
545545 Health and Safety Code, or in Penalty Group 1, 1-A, 2, 2-A, 2-B, 3,
546546 or 4, Chapter 481; or
547547 (B) included in Schedule I, II, III, IV, or V of
548548 the Comprehensive Drug Abuse Prevention and Control Act of 1970 (21
549549 U.S.C. Section 801 et seq.).
550550 (12) "Dangerous drug" means a drug or device that:
551551 (A) is not included in Penalty Group 1, 1-A, 2,
552552 2-A, 2-B, 3, or 4, Chapter 481, Health and Safety Code, and is
553553 unsafe for self-medication; or
554554 (B) bears or is required to bear the legend:
555555 (i) "Caution: federal law prohibits
556556 dispensing without prescription" or "Rx only" or another legend
557557 that complies with federal law; or
558558 (ii) "Caution: federal law restricts this
559559 drug to use by or on the order of a licensed veterinarian."
560560 SECTION 19. The change in law made by this Act applies only
561561 to an offense committed on or after the effective date of this Act.
562562 An offense committed before the effective date of this Act is
563563 governed by the law in effect when the offense was committed, and
564564 the former law is continued in effect for that purpose. For purposes
565565 of this section, an offense was committed before the effective date
566566 of this Act if any element of the offense occurred before that date.
567567 SECTION 20. This Act takes effect September 1, 2021.
