55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the definition of economically disadvantaged person for
88 the purposes of determining whether a business is a historically
99 underutilized business.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 2161.001(3), Government Code, is amended
1212 to read as follows:
1313 (3) "Economically disadvantaged person" means a
1414 person who:
1515 (A) is economically disadvantaged because of the
1616 person's identification as a member of a certain group, including:
1717 (i) Black Americans;
1818 (ii) Hispanic Americans;
1919 (iii) women;
2020 (iv) Asian Pacific Americans;
2121 (v) Subcontinent Asian Americans;
2222 (vi) Native Americans; and
2323 (vii) [(vi)] veterans as defined by 38
2424 U.S.C. Section 101(2) who have suffered at least a 20 percent
2525 service-connected disability as defined by 38 U.S.C. Section
2626 101(16); and
2727 (B) has suffered the effects of discriminatory
2828 practices or other similar insidious circumstances over which the
2929 person has no control.
3030 SECTION 2. This Act takes effect September 1, 2021.
