9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. The heading to Section 86.0015, Election Code, |
---|
11 | 11 | | is amended to read as follows: |
---|
12 | 12 | | Sec. 86.0015. [ANNUAL] BALLOTS BY MAIL FOR MULTIPLE |
---|
13 | 13 | | ELECTIONS FOLLOWING SINGLE APPLICATION. |
---|
14 | 14 | | SECTION 2. Section 86.0015, Election Code, is amended by |
---|
15 | 15 | | amending Subsection (b) and adding Subsection (g) to read as |
---|
16 | 16 | | follows: |
---|
17 | 17 | | (b) An application described by Subsection (a) is |
---|
18 | 18 | | considered to be an application for a ballot for each election, |
---|
19 | 19 | | including any ensuing runoff: |
---|
20 | 20 | | (1) in which the applicant is eligible to vote; and |
---|
21 | 21 | | (2) that occurs before the earlier of: |
---|
22 | 22 | | (A) [except as provided by Subsection (b-2),] the |
---|
23 | 23 | | end of the next calendar year following the calendar year in which |
---|
24 | 24 | | the application was submitted; |
---|
25 | 25 | | (B) the date the county clerk receives notice |
---|
26 | 26 | | from the voter registrar under Subsection (f) that the voter has |
---|
27 | 27 | | changed residence to another county; or |
---|
28 | 28 | | (C) the date the voter's registration is |
---|
29 | 29 | | canceled. |
---|
30 | 30 | | (g) The county clerk shall provide to a voter who has |
---|
31 | 31 | | applied for and qualifies to receive ballots to be voted by mail |
---|
32 | 32 | | under this section, before the end of the last calendar year for |
---|
33 | 33 | | which the voter will receive ballots under this section, a notice |
---|
34 | 34 | | stating that the voter must make a new application under this |
---|
35 | 35 | | section if the voter wishes to continue to receive ballots to be |
---|
36 | 36 | | voted by mail. |
---|
37 | 37 | | SECTION 3. Section 86.0015(b-2), Election Code, is |
---|
38 | 38 | | repealed. |
---|
39 | 39 | | SECTION 4. The change in law made by this Act to Section |
---|
40 | 40 | | 86.0015, Election Code, applies only to an application for a ballot |
---|
41 | 41 | | to be voted by mail submitted on or after the effective date of this |
---|
42 | 42 | | Act. An application for a ballot to be voted by mail submitted |
---|
43 | 43 | | before the effective date of this Act is governed by the law in |
---|
44 | 44 | | effect when the application was submitted, and the former law is |
---|
45 | 45 | | continued in effect for that purpose. |
---|
46 | 46 | | SECTION 5. This Act takes effect September 1, 2021. |
