69 relating to the light-duty motor vehicle purchase or lease
710 incentive program.
811 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
912 SECTION 1. Section 386.154, Health and Safety Code, is
10- amended by adding Subsections (f), (g), and (h) to read as follows:
11- (f) A new motorcycle powered by an electric drive is
12- eligible for a $1,250 incentive if the vehicle:
13- (1) is a motorcycle as defined by Section 541.201,
14- Transportation Code;
13+ amended by amending Subsection (d) and adding Subsection (f) to
14+ read as follows:
15+ (d) A new light-duty motor vehicle powered by an electric
16+ drive is eligible for a $2,500 incentive if the vehicle:
17+ (1) has four wheels or is a motorcycle as defined by
18+ Section 541.201, Transportation Code;
1519 (2) was manufactured for use primarily on public
1620 streets, roads, and highways;
1721 (3) has not been modified from the original
1822 manufacturer's specifications;
1923 (4) has a maximum speed capability of at least 55 miles
2024 per hour;
2125 (5) is propelled to a significant extent by an
2226 electric motor that draws electricity from a hydrogen fuel cell or
2327 from a battery that:
2428 (A) has a capacity of not less than four kilowatt
2529 hours; and
2630 (B) is capable of being recharged from an
27- external source of electricity;
28- (6) was acquired on or after September 1, 2021, or a
31+ external source of electricity; [and]
32+ (6) was acquired on or after September 1, 2013, or a
2933 later date as established by the commission, by the person applying
3034 for the incentive under this subsection and for use or lease by that
3135 person and not for resale; and
3236 (7) is not a motor-assisted scooter or pocket bike or
3337 minimotorbike as those terms are defined by Section 551.351,
3438 Transportation Code.
35- (g) The incentive under Subsection (f) is limited to 100
36- vehicles for the first state fiscal year of the biennium and 200
37- vehicles for the second state fiscal year of the biennium. This
38- subsection expires August 31, 2022.
39- (h) The incentive under Subsection (f) is limited to 500
40- vehicles each state fiscal biennium.
39+ (f) A person that receives the incentive described by
40+ Subsection (d) shall remit $750 to the comptroller to deposit to the
41+ credit of the state highway fund. Money deposited to the credit of
42+ the state highway fund under this subsection must be used in a
43+ manner consistent with the purposes specified by Section 7-a,
44+ Article VIII, Texas Constitution.
4145 SECTION 2. This Act takes effect immediately if it receives
4246 a vote of two-thirds of all the members elected to each house, as
4347 provided by Section 39, Article III, Texas Constitution. If this
4448 Act does not receive the vote necessary for immediate effect, this
4549 Act takes effect September 1, 2021.
